AMENDMENT TO SENATE BILL 1494

2     AMENDMENT NO. ______. Amend Senate Bill 1494 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Counties Code is amended by changing
5 Section 5-1025 as follows:
 
6     (55 ILCS 5/5-1025)  (from Ch. 34, par. 5-1025)
7     Sec. 5-1025. Tax for expense of conducting elections and
8 maintaining system of permanent registration of voters. In
9 counties of more than 1,000,000 inhabitants, a county board may
10 levy and collect, in odd numbered years, a tax of not to exceed
11 .05% of the value, as equalized or assessed by the Department
12 of Revenue, of all the taxable property in the county, for the
13 expense of conducting elections and maintaining a system of
14 permanent registration of voters. Such tax shall not be
15 included within any statutory limitation of rate or amount for
16 other county purposes, but shall be excluded therefrom and be

1 in addition thereto and in excess thereof; provided that this
2 tax shall not be levied or collected on property situated
3 within the jurisdiction of any municipal board of election
4 commissioners.
5     Beginning with calendar year 1986 and annually thereafter,
6 any county with less than 1,000,000 inhabitants shall pay over
7 to any municipal board of election commissioners in the county,
8 for the expense of conducting elections and maintaining a
9 system of permanent registration of voters, an amount at least
10 equal to the proceeds of the tax collected on property situated
11 within the jurisdiction of that board under this Section during
12 calendar year 1985; provided, however, such amount shall be
13 increased or decreased annually in proportion to any increase
14 or decrease in the equalized assessed valuation of such
15 municipality. Notwithstanding any other provision of this Code
16 to the contrary, beginning with the first payment after the
17 effective date of this amendatory Act of the 95th General
18 Assembly, the amount paid over annually to the municipal board
19 of election commissioners for the City of Rockford shall be
20 equal to the amount paid over to that municipal board of
21 election commissioners in calendar year 1992. Such amount shall
22 be payable from the tax levied and collected under Section
23 5-1024.
