SYNOPSIS AS INTRODUCED:

30 ILCS 805/8.31 new

    Amends the Illinois Highway Code. Provides that any recipient of State funds shall give the highest priority to the use of energy efficient lights in any traffic control devices funded by State moneys. Limits home rule powers. Amends the State Mandates Act to require implementation without reimbursement by the State. Effective immediately.

1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Highway Code is amended by adding
5 Section 9-131 as follows:
 
6     (605 ILCS 5/9-131 new)
7     Sec. 9-131. Energy efficient lighting.
8     (a) Definitions. As used in this Section:
9         (1) "Energy efficient lights" means light emitting
10     diode traffic lights or other lights that the Department of
11     Transportation shall find to be as or more energy efficient
12     that light emitting diode lights.
13         (2) "Highest priority" means that the priority shall be
14     given as specified unless the Department of Transportation
15     finds that giving such priority will cause an unreasonable
16     burden.
17         (3) "Recipient" means any unit of government including
18     but not limited to counties, townships and municipalities
19     that receive State funds for construction, maintenance, or
20     rehabilitation of any roads or highways, or for the design,
21     construction, or maintenance of any road or highway
22     intersections, or for the purchase, installation,
23     rehabilitation or maintenance of any traffic control

1     devices.
2         (4) All other phrases have the definitions commonly
3     ascribed to them unless the Illinois Highway Code otherwise
4     specifies a specific definition.
5     (b) Energy efficient lights in traffic control devices. Any
6 recipient of State funds shall give highest priority to the use
7 of energy efficient lights in any traffic control devices whose
8 purchase, installation, rehabilitation or maintenance is
9 funded in whole or in part by any state funds.
10     (c) A home rule unit must comply with the requirements of
11 this Act. A home rule unit may not adopt or enforce any
12 regulations inconsistent with this Act. This Section is
13 limitation under subsection (i) of Section 6 of Article VII of
14 the Illinois Constitution on the concurrent exercise by home
15 rule units of powers and functions exercised by the State.
 
16     Section 90. The State Mandates Act is amended by adding
17 Section 8.31 as follows:
 
18     (30 ILCS 805/8.31 new)
19     Sec. 8.31. Exempt mandate. Notwithstanding Sections 6 and 8
20 of this Act, no reimbursement by the State is required for the
21 implementation of any mandate created by this amendatory Act of
22 the 95th General Assembly.
 
23     Section 99. Effective date. This Act takes effect upon
24 becoming law.
