AMENDMENT TO SENATE BILL 829

2     AMENDMENT NO. ______. Amend Senate Bill 829 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Counties Code is amended by changing
5 Sections 3-15004 and 3-15005 as follows:
 
6     (55 ILCS 5/3-15004)  (from Ch. 34, par. 3-15004)
7     Sec. 3-15004. Board. A Board of 7 5 members shall be
8 appointed by the Sheriff with the advice and consent of the
9 County Board to recommend the policy of the Department, and to
10 establish rules for regulating the Board's organization and for
11 the administration of this Division. The Board shall not have
12 administrative or executive duties and shall not deal with
13 specific procedural matters.

1     Sec. 3-15005. Appointment of members of board. The 5
2 members of the Board first appointed shall be appointed as
3 follows: (a) Three qualified persons shall be appointed by the
4 Sheriff; (b) and 2 qualified persons shall be nominated by the
5 President of the County Board and appointed by the Sheriff.
6     Within 90 days after the effective date of this amendatory
7 Act of the 95th General Assembly, the Sheriff shall appoint 2
8 additional members to the Board. One member shall serve for a
9 4-year term and one member shall serve for a 5-year term. Their
10 successors shall be appointed for 5-year terms.
11     Pursuant to the provisions of this Division which were in
12 effect immediately before October 1, 1977, the terms of the
13 members of the Board then serving shall expire, one on January
14 1, 1978, one on January 1, 1979, one on January 1, 1980, one on
15 January 1, 1981, and one on January 1, 1982.
16     Any member may be reappointed. Subsequent appointments
17 shall be for terms of 5 years from January 1 of the year of
18 appointment. Each member shall hold office until the
19 appointment and qualification of his successor. Successors to
20 the members first appointed and their successors shall be
21 appointed as follows: (a) the successor to the member first
22 appointed by the Sheriff shall likewise be appointed by the
23 Sheriff; (b) the successors to the members first nominated by
24 the President of the County Board and appointed by the Sheriff
25 shall likewise be nominated by the President of the County
26 Board and appointed by the Sheriff; and (c) the successors to

1 the members first nominated by the mayor of the largest city
2 within the county and appointed by the Sheriff shall be
3 appointed by the Sheriff.
