AMENDMENT TO SENATE BILL 674

2     AMENDMENT NO. ______. Amend Senate Bill 674 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 1. Short title. This Act may be cited as the
5 Student Referendum Act.
 
6     Section 5. Definitions. In this Act:
7     "Full-time student" means a student enrolled for at least
8 12 hours per term or as otherwise determined by the public
9 institution of higher education.
10     "Part-time student" means a person who is enrolled for at
11 least one-third of the number of hours required per term by the
12 public institution of higher education for its full time
13 students.
14     "President" means the president, chancellor, or other lead
15 official of the public institution of higher education.
16     "Public institution of higher education" means an

1 institution that is included in the definition of "public
2 institutions of higher education" under the Board of Higher
3 Education Act.
4     "Term of enrollment" means a semester, quarter, or
5 trimester, as appropriate to the public institution of higher
6 education.
 
7     Section 10. Applicability. The provisions of this Act apply
8 to each public institution of higher education in this State.
 
9     Section 15. Student-initiated referendums.
10     (a) The governing body of each public institution of higher
11 education shall establish procedures providing for
12 student-initiated fee referendums at a date no later than
13 December 31, 2007.
14     (b) Students at a public institution of higher education
15 may, by a majority vote of the students participating in the
16 referendum, authorize the imposition of a fee to be imposed
17 upon each full-time and part-time student as provided in this
18 Section.
19     (c) The President shall establish reasonable procedures
20 for the submission of student-initiated fee referendums, the
21 scheduling of referendum votes, and the collection of the fees.
22     (d) The petition for a student-initiated fee referendum
23 shall clearly identify the amount of money per student that
24 will be authorized by the referendum. The governing body of

1 each public institution of higher education shall establish a
2 reasonable maximum amount of dollars for the fee per full-time
3 student per term of enrollment.
4     (e) The amount authorized in subsection (d) of this Section
5 and affirmed by the student vote shall be imposed on each
6 full-time student enrolled in the public institution of higher
7 education at the start of the next following term of
8 enrollment. Part-time students shall pay a pro-rata share of
9 the fee based on the number of instructional hours registered
10 for.
 
11     Section 20. Report. The Board of Higher Education, with the
12 cooperation of each public institution of higher education,
13 shall report to the Governor and General Assembly no later than
14 2 years following the effective date of this Act. The report
15 shall include, at a minimum, (i) the procedures for
16 student-initiated fee referendums at each public institution
17 of higher education, (ii) the amount of money raised by each
18 successful student-initiated referendum fee, and (iii) a
19 description of the projects funded by these fees.
 
20     Section 99. Effective date. This Act takes effect upon
21 becoming law.".
