AMENDMENT TO SENATE BILL 593

2     AMENDMENT NO. ______. Amend Senate Bill 593, AS AMENDED, in
3 Section 5, Sec. 5-101, subsec. (A), paragraph (11), immediately
4 after "education", by replacing the following:", except the
5 Department shall not have jurisdiction over charges involving
6 curriculum content, course content, or course offerings" with
7 the following:
8 "in regard to the failure to enroll an individual or the denial
9 of access to its facilities, goods, or services, except that
10 the Department shall not have jurisdiction over charges
11 involving curriculum content, course content, or course
12 offerings, conduct of the class by the teacher or instructor,
13 or any activity within the classroom or connected with a class
14 activity such as physical education;"; and
 
15 in Section 5, Sec. 5-102.1, immediately after "No Civil Rights
16 Violation: Public Accommodations." by replacing everything
17 remaining in Sec. 5-102.1 with the following:

1 "It is not a civil rights violation for a medical, dental, or
2 other health care professional or a private professional
3 service provider such as a lawyer, accountant, or insurance
4 agent to refer or refuse to treat or provide services to an
5 individual in a protected class for any non-discriminatory
6 reason if, in the normal course of his or her operations or
7 business, the professional would for the same reason refer or
8 refuse to treat or provide services to an individual who is not
9 in the protected class of the individual who seeks or requires
10 the same or similar treatment or services.".
