| 2 | AMENDMENT NO. ______. Amend Senate Bill 325, AS AMENDED, by | ||||||
| 3 | replacing everything after the enacting clause with the | ||||||
| 4 | following:
| ||||||
| 5 | "Section 1. Short title. This Act may be cited as the | ||||||
| 6 | Textbook Advisory Committee Act. | ||||||
| 7 | Section 5. Findings; purpose. The General Assembly finds | ||||||
| 8 | that the State and its residents would benefit from increased | ||||||
| 9 | affordability at public institutions of higher education. In | ||||||
| 10 | pursuit of this common goal, the faculty and administration at | ||||||
| 11 | all public institutions of higher education must consider the | ||||||
| 12 | most cost-effective practices in textbook decision-making. The | ||||||
| 13 | purpose of this Act is to foster the development of | ||||||
| 14 | institutional textbook adoption policies with the aim of | ||||||
| 15 | reducing textbook costs to students. | ||||||

| |||||||
| 1 | Section 10. Definitions. In this Act: | ||||||
| 2 | "Off-campus college bookstore" means a bookstore that is | ||||||
| 3 | not operated by or on behalf of the public institution of | ||||||
| 4 | higher education, but sells or offers to sell textbooks and | ||||||
| 5 | supplemental materials to students and has a physical presence | ||||||
| 6 | on or near the institution's campus. | ||||||
| 7 | "On-campus college bookstore" means a bookstore, whether | ||||||
| 8 | operated by or on behalf of the public institution of higher | ||||||
| 9 | education, that sells or offers to sell textbooks and | ||||||
| 10 | supplemental materials to students of the public institution of | ||||||
| 11 | higher education and that has a physical presence on or near | ||||||
| 12 | the institution's campus. | ||||||
| 13 | "Public institution of higher education" means an | ||||||
| 14 | institution that is included in the definition of "public | ||||||
| 15 | institutions of higher education" under the Board of Higher | ||||||
| 16 | Education Act, but does not include a public institution of | ||||||
| 17 | higher education whose primary method of textbook issuance is | ||||||
| 18 | through a rental program. | ||||||
| 19 | "Publisher" means any publishing house, publishing firm, | ||||||
| 20 | or publishing company that publishes instructional materials | ||||||
| 21 | and supplemental materials. | ||||||
| 22 | Section 15. Textbook advisory committees established. A | ||||||
| 23 | textbook advisory committee must be established in the office | ||||||
| 24 | of the provost or chief academic officer of each public | ||||||
| 25 | institution of higher education. The committee must be | ||||||

| 1 | comprised of cross-disciplinary teams of faculty and | ||||||
| 2 | representatives of the administration, representatives of the | ||||||
| 3 | on-campus college bookstore and off-campus college bookstore, | ||||||
| 4 | if any, that provide textbooks, students, and a publisher. | ||||||
| 5 | Section 20. Policies. A textbook advisory committee | ||||||
| 6 | established under this Act shall establish and implement | ||||||
| 7 | policies to do all of the following: | ||||||
| 8 | (1) Establish deadlines for faculty to notify a | ||||||
| 9 | bookstore or bookstores of textbooks selected for the | ||||||
| 10 | pending semester or other term. | ||||||
| 11 | (2) Ensure the publication, on the public institution | ||||||
| 12 | of higher education's Internet website or at other | ||||||
| 13 | appropriate venues, of the title, author, International | ||||||
| 14 | Standard Book Number (ISBN), and retail price of new and | ||||||
| 15 | used textbooks within reasonable expediency after the | ||||||
| 16 | information becomes available. The requirement for | ||||||
| 17 | disclosure of the International Standard Book Number | ||||||
| 18 | (ISBN) under this Section is applicable so long as | ||||||
| 19 | disclosure does not conflict with or impair the contractual | ||||||
| 20 | rights of a private third party that operates the on-campus | ||||||
| 21 | college bookstore on behalf of the public institution of | ||||||
| 22 | higher education. | ||||||
| 23 | (3) Ensure the availability of information regarding | ||||||
| 24 | how current editions of textbooks differ from previous | ||||||
| 25 | editions. | ||||||

| 1 | (4) Prohibit employees and departments of the public | ||||||
| 2 | institution of higher education from demanding or | ||||||
| 3 | receiving any present or promised gift, payment, loan, | ||||||
| 4 | subscription, advance deposit of money, services, or other | ||||||
| 5 | thing of value as an inducement for the selection of any | ||||||
| 6 | specific textbook or supplemental material for use in an | ||||||
| 7 | academic course taught at the public institution of higher | ||||||
| 8 | education. This item (3) does not prevent instructors of | ||||||
| 9 | the public institution of higher education from receiving | ||||||
| 10 | any of the following: | ||||||
| 11 | (A) Sample copies, instructor's copies, or | ||||||
| 12 | instructional materials that are not to be sold by | ||||||
| 13 | instructors, staff, on-campus college bookstores, or | ||||||
| 14 | off-campus college bookstores, if any. | ||||||
| 15 | (B) Royalties or other compensation from sales of | ||||||
| 16 | textbooks or supplemental materials that include the | ||||||
| 17 | instructor's own writing or written work, as | ||||||
| 18 | determined by the textbook advisory committee. | ||||||
| 19 | (C) Training in the use of course materials and | ||||||
| 20 | learning technologies. | ||||||
| 21 | (D) Honoraria for academic peer review of course | ||||||
| 22 | materials. | ||||||
| 23 | (5) Foster the establishment of textbook reserves, | ||||||
| 24 | including online electronic collections ("e-reserves"), | ||||||
| 25 | for student use in campus libraries or academic | ||||||
| 26 | departments, free of charge, so long as all materials | ||||||
| |||||||
| |||||||
| 1 | provided adhere to applicable federal copyright laws. | ||||||
| 2 | (6) Encourage buy-back programs to reduce student | ||||||
| 3 | costs. | ||||||
| 4 | (7) Provide support for the creation or operation of | ||||||
| 5 | campus book swaps. | ||||||
| 6 | The committee may implement other policies as desired to | ||||||
| 7 | provide textbook cost savings to students.
| ||||||
| 8 | Section 25. Report. Each public institution of higher | ||||||
| 9 | education shall report annually to the Board of Higher | ||||||
| 10 | Education or the Illinois Community College Board, as | ||||||
| 11 | appropriate, on measures undertaken to reduce textbook costs | ||||||
| 12 | and provide students with cost-saving alternatives. The report | ||||||
| 13 | shall include a full listing of student costs for a | ||||||
| 14 | representative sample of textbooks for coursework for | ||||||
| 15 | first-time, full-time students in a manner prescribed by the | ||||||
| 16 | Board of Higher Education or the Illinois Community College | ||||||
| 17 | Board, as appropriate. | ||||||
| 18 | Section 80. Expiration. This Act is repealed on June 30, | ||||||
| 19 | 2015.".
