2 | AMENDMENT NO. ______. Amend Senate Bill 325 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 1. Short title. This Act may be cited as the | ||||||
5 | Textbook Advisory Committee Act. | ||||||
6 | Section 5. Findings; purpose. The General Assembly finds | ||||||
7 | that the State and its residents would benefit from increased | ||||||
8 | affordability at public institutions of higher education. In | ||||||
9 | pursuit of this common goal, the faculty and administration at | ||||||
10 | all public institutions of higher education must consider the | ||||||
11 | most cost-effective practices in textbook decision-making. The | ||||||
12 | purpose of this Act is to foster the development of | ||||||
13 | institutional textbook adoption policies with the aim of | ||||||
14 | reducing textbook costs to students. | ||||||
15 | Section 10. Definition. In this Act, "public institution |

1 | of higher education" means an institution that is included in | ||||||
2 | the definition of "public institutions of higher education" | ||||||
3 | under the Board of Higher Education Act, but does not include a | ||||||
4 | public institution of higher education whose primary method of | ||||||
5 | textbook issuance is through a rental program. | ||||||
6 | Section 15. Textbook advisory committees established. A | ||||||
7 | textbook advisory committee must be established in the office | ||||||
8 | of the provost or chief academic officer of each public | ||||||
9 | institution of higher education. The committee must be | ||||||
10 | comprised of cross-disciplinary teams of faculty and | ||||||
11 | representatives of the administration, representatives of the | ||||||
12 | bookstore or bookstores that provide textbooks, and students. | ||||||
13 | Section 20. Policies. A textbook advisory committee | ||||||
14 | established under this Act shall establish and implement | ||||||
15 | policies to do all of the following: | ||||||
16 | (1) Establish deadlines for faculty to notify a | ||||||
17 | bookstore or bookstores of textbooks selected for the | ||||||
18 | pending semester or other term. | ||||||
19 | (2) Ensure the publication, on the public institution | ||||||
20 | of higher education's Internet website or at other | ||||||
21 | appropriate venues, of the title, author, International | ||||||
22 | Standard Book Number (ISBN), and retail price of new and | ||||||
23 | used textbooks within reasonable expediency after the | ||||||
24 | information becomes available; and ensure the availability |

1 | of information regarding how current editions of textbooks | ||||||
2 | differ from previous editions. | ||||||
3 | (3) Prohibit employees of the public institution of | ||||||
4 | higher education and academic departments from demanding | ||||||
5 | or receiving any present or promised gift, payment, loan, | ||||||
6 | subscription, advance deposit of money, services, or other | ||||||
7 | thing of value as an inducement for the selection of any | ||||||
8 | specific textbook or supplemental material for use in an | ||||||
9 | academic course taught at the public institution of higher | ||||||
10 | education. This item (3) does not prevent instructors of | ||||||
11 | the public institution of higher education from receiving | ||||||
12 | any of the following: | ||||||
13 | (A) Sample copies, instructor's copies, or | ||||||
14 | instructional materials. | ||||||
15 | (B) Royalties or other compensation from sales of | ||||||
16 | textbooks or supplemental materials that include the | ||||||
17 | instructor's own writing or written work, as | ||||||
18 | determined by the textbook advisory committee. | ||||||
19 | (C) Training in the use of course materials and | ||||||
20 | learning technologies. | ||||||
21 | (D) Honoraria for academic peer review of course | ||||||
22 | materials. | ||||||
23 | (4) Foster the establishment of textbook reserves, | ||||||
24 | including online electronic collections ("e-reserves"), | ||||||
25 | for student use in campus libraries or academic | ||||||
26 | departments, free of charge. |

1 | (5) Encourage buy-back programs to expand the | ||||||
2 | availability of used textbooks and reduce student costs. | ||||||
3 | (6) Provide support for the creation or operation of | ||||||
4 | campus book swaps. | ||||||
5 | The committee may implement other policies as desired to | ||||||
6 | provide textbook cost savings to students.

7 | Section 25. Report. Each public institution of higher | ||||||
8 | education shall report annually to the Board of Higher | ||||||
9 | Education or the Illinois Community College Board, as | ||||||
10 | appropriate, on measures undertaken to reduce textbook costs | ||||||
11 | and provide students with cost-saving alternatives. The report | ||||||
12 | shall include a full listing of student costs for a | ||||||
13 | representative sample of textbooks for coursework for | ||||||
14 | first-time, full-time students in a manner prescribed by the | ||||||
15 | Board of Higher Education or the Illinois Community College | ||||||
16 | Board, as appropriate. | ||||||
17 | Section 80. Expiration. This Act is repealed on June 30, | ||||||
18 | 2015.".
