1 | AN ACT concerning education.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 1. Short title. This Act may be cited as the | ||||||
5 | Textbook Advisory Committee Act. | ||||||
6 | Section 5. Findings; purpose. The General Assembly finds | ||||||
7 | that the State and its residents would benefit from increased | ||||||
8 | affordability at public institutions of higher education. In | ||||||
9 | pursuit of this common goal, the faculty and administration at | ||||||
10 | all public institutions of higher education must consider the | ||||||
11 | most cost-effective practices in textbook decision-making. The | ||||||
12 | purpose of this Act is to foster the development of | ||||||
13 | institutional textbook adoption policies with the aim of | ||||||
14 | reducing textbook costs to students. | ||||||
15 | Section 10. Definitions. In this Act: | ||||||
16 | "Off-campus college bookstore" means a bookstore that is | ||||||
17 | not operated by or on behalf of the public institution of | ||||||
18 | higher education, but sells or offers to sell textbooks and | ||||||
19 | supplemental materials to students and has a physical presence | ||||||
20 | on or near the institution's campus. | ||||||
21 | "On-campus college bookstore" means a bookstore, whether | ||||||
22 | operated by or on behalf of the public institution of higher |

1 | education, that sells or offers to sell textbooks and | ||||||
2 | supplemental materials to students of the public institution of | ||||||
3 | higher education and that has a physical presence on or near | ||||||
4 | the institution's campus. | ||||||
5 | "Public institution of higher education" means an | ||||||
6 | institution that is included in the definition of "public | ||||||
7 | institutions of higher education" under the Board of Higher | ||||||
8 | Education Act, but does not include a public institution of | ||||||
9 | higher education whose primary method of textbook issuance is | ||||||
10 | through a rental program. | ||||||
11 | "Publisher" means any publishing house, publishing firm, | ||||||
12 | or publishing company that publishes instructional materials | ||||||
13 | and supplemental materials. | ||||||
14 | Section 15. Textbook advisory committees established. A | ||||||
15 | textbook advisory committee must be established in the office | ||||||
16 | of the provost or chief academic officer of each public | ||||||
17 | institution of higher education. The committee must be | ||||||
18 | comprised of cross-disciplinary teams of faculty and | ||||||
19 | representatives of the administration, representatives of the | ||||||
20 | on-campus college bookstore and off-campus college bookstore, | ||||||
21 | if any, that provide textbooks, students, and a publisher. | ||||||
22 | Section 20. Policies. A textbook advisory committee | ||||||
23 | established under this Act shall establish and implement | ||||||
24 | policies to do all of the following: |

1 | (1) Establish deadlines for faculty to notify a | ||||||
2 | bookstore or bookstores of textbooks selected for the | ||||||
3 | pending semester or other term. | ||||||
4 | (2) Ensure the publication, on the public institution | ||||||
5 | of higher education's Internet website or at other | ||||||
6 | appropriate venues, of the title, author, International | ||||||
7 | Standard Book Number (ISBN), and retail price of new and | ||||||
8 | used textbooks within reasonable expediency after the | ||||||
9 | information becomes available. The requirement for | ||||||
10 | disclosure of the International Standard Book Number | ||||||
11 | (ISBN) under this Section is applicable so long as | ||||||
12 | disclosure does not conflict with or impair the contractual | ||||||
13 | rights of a private third party that operates the on-campus | ||||||
14 | college bookstore on behalf of the public institution of | ||||||
15 | higher education. | ||||||
16 | (3) Ensure the availability of information regarding | ||||||
17 | how current editions of textbooks differ from previous | ||||||
18 | editions. | ||||||
19 | (4) Prohibit employees and departments of the public | ||||||
20 | institution of higher education from demanding or | ||||||
21 | receiving any present or promised gift, payment, loan, | ||||||
22 | subscription, advance deposit of money, services, or other | ||||||
23 | thing of value as an inducement for the selection of any | ||||||
24 | specific textbook or supplemental material for use in an | ||||||
25 | academic course taught at the public institution of higher | ||||||
26 | education. This item (4) does not prevent instructors of |

1 | the public institution of higher education from receiving | ||||||
2 | any of the following: | ||||||
3 | (A) Sample copies, instructor's copies, or | ||||||
4 | instructional materials that are not to be sold by | ||||||
5 | instructors, staff, on-campus college bookstores, or | ||||||
6 | off-campus college bookstores, if any. | ||||||
7 | (B) Royalties or other compensation from sales of | ||||||
8 | textbooks or supplemental materials that include the | ||||||
9 | instructor's own writing or written work, as | ||||||
10 | determined by the textbook advisory committee. | ||||||
11 | (C) Training in the use of course materials and | ||||||
12 | learning technologies. | ||||||
13 | (D) Honoraria for academic peer review of course | ||||||
14 | materials. | ||||||
15 | (5) Foster the establishment of textbook reserves, | ||||||
16 | including online electronic collections ("e-reserves"), | ||||||
17 | for student use in campus libraries or academic | ||||||
18 | departments, free of charge, so long as all materials | ||||||
19 | provided adhere to applicable federal copyright laws. | ||||||
20 | (6) Encourage buy-back programs to reduce student | ||||||
21 | costs. | ||||||
22 | (7) Provide support for the creation or operation of | ||||||
23 | campus book swaps. | ||||||
24 | The committee may implement other policies as desired to | ||||||
25 | provide textbook cost savings to students.

1 | Section 25. Report. Each public institution of higher | ||||||
2 | education shall report annually to the Board of Higher | ||||||
3 | Education or the Illinois Community College Board, as | ||||||
4 | appropriate, on measures undertaken to reduce textbook costs | ||||||
5 | and provide students with cost-saving alternatives. The report | ||||||
6 | shall include a full listing of student costs for a | ||||||
7 | representative sample of textbooks for coursework for | ||||||
8 | first-time, full-time students in a manner prescribed by the | ||||||
9 | Board of Higher Education or the Illinois Community College | ||||||
10 | Board, as appropriate. | ||||||
11 | Section 80. Expiration. This Act is repealed on June 30, | ||||||
12 | 2015.
