SYNOPSIS AS INTRODUCED:

    Amends the Illinois Income Tax Act. Creates a tax checkoff for the Crisis Nursery Fund. Amends the State Finance Act to create the Fund. Amends the Children and Family Services Act. Provides that, from appropriations to the Department of Children and Family Services, the Department shall make grants, in equal amounts, to the member entities of the Crisis Nursery Coalition of Illinois. Effective immediately.

1     AN ACT concerning revenue.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Children and Family Services Act is amended
5 by adding Section 12.3 as follows:
 
6     (20 ILCS 505/12.3 new)
7     Sec. 12.3. The Crisis Nursery Fund. The Crisis Nursery Fund
8 is created as a special fund in the State treasury. From
9 appropriations to the Department from the Fund, the Department
10 shall make grants, in equal amounts, to the member entities of
11 the Crisis Nursery Coalition of Illinois, which are the
12 Crittendon Center in Peoria, the Crisis Nursery in Urbana, the
13 Children's Foundation in Bloomington, the MotherHouse Crisis
14 Nursery Program in Rockford, the Mini O'Beirne Crisis Nursery
15 in Springfield, and the Maryville Academy Children's Center
16 Crisis Nursery in Chicago.
 
17     Section 10. The State Finance Act is amended by adding
18 Section 5.675 as follows:

1     Section 15. The Illinois Income Tax Act is amended by
2 adding Section 507OO and by changing Sections 509 and 510 as
3 follows:
 
4     (35 ILCS 5/507OO new)
5     Sec. 507OO. The crisis nursery checkoff. For taxable years
6 ending on or after December 31, 2007, the Department shall
7 print, on its standard individual income tax form, a provision
8 indicating that, if the taxpayer wishes to contribute to the
9 Crisis Nursery Fund, as authorized by this amendatory Act of
10 the 95th General Assembly, then he or she may do so by stating
11 the amount of the contribution (not less than $1) on the return
12 and indicating that the contribution will reduce the taxpayer's
13 refund or increase the amount of payment to accompany the
14 return. The taxpayer's failure to remit any amount of the
15 increased payment reduces the contribution accordingly. This
16 Section does not apply to any amended return.

18     Sec. 509. Tax checkoff explanations. All individual income
19 tax return forms shall contain appropriate explanations and
20 spaces to enable the taxpayers to designate contributions to
21 the following funds: the Child Abuse Prevention Fund, the
22 Illinois Wildlife Preservation Fund (as required by the
23 Illinois Non-Game Wildlife Protection Act), the Alzheimer's
24 Disease Research Fund (as required by the Alzheimer's Disease

1 Research Act), the Assistance to the Homeless Fund (as required
2 by this Act), the Penny Severns Breast and Cervical Cancer
3 Research Fund, the National World War II Memorial Fund, the
4 Prostate Cancer Research Fund, the Lou Gehrig's Disease (ALS)
5 Research Fund, the Multiple Sclerosis Assistance Fund, the
6 Sarcoidosis Research Fund, the Leukemia Treatment and
7 Education Fund, the World War II Illinois Veterans Memorial
8 Fund, the Korean War Veterans National Museum and Library Fund,
9 the Illinois Military Family Relief Fund, the Blindness
10 Prevention Fund, the Illinois Veterans' Homes Fund, the
11 Epilepsy Treatment and Education Grants-in-Aid Fund, the
12 Diabetes Research Checkoff Fund, the Vince Demuzio Memorial
13 Colon Cancer Fund, the Autism Research Fund, the Heartsaver AED
14 Fund, the Asthma and Lung Research Fund, the Crisis Nursery
15 Fund, and the Illinois Brain Tumor Research Fund.
16     Each form shall contain a statement that the contributions
17 will reduce the taxpayer's refund or increase the amount of
18 payment to accompany the return. Failure to remit any amount of
19 increased payment shall reduce the contribution accordingly.
20     If, on October 1 of any year, the total contributions to
21 any one of the funds made under this Section do not equal
22 $100,000 or more, the explanations and spaces for designating
23 contributions to the fund shall be removed from the individual
24 income tax return forms for the following and all subsequent
25 years and all subsequent contributions to the fund shall be
26 refunded to the taxpayer.

9 Department shall determine the total amount contributed to each
10 of the following: the Child Abuse Prevention Fund, the Illinois

1 notify the State Comptroller and the State Treasurer of the
2 amounts to be transferred from the General Revenue Fund to each
3 fund, and upon receipt of such notification the State Treasurer
4 and Comptroller shall transfer the amounts.

11     Section 99. Effective date. This Act takes effect upon
12 becoming law.
