SYNOPSIS AS INTRODUCED:
 
ILCON Art. V, Sec. 1
ILCON Art. V, Sec. 3
ILCON Art. V, Sec. 7
ILCON Art. V, Sec. 17
ILCON Art. V, Sec. 18

    Proposes to amend the Executive Article of the Illinois Constitution. Eliminates the Offices of the Comptroller and Treasurer. Provides instead for a single Comptroller of the Treasury. Provides that the Comptroller of the Treasury shall (i) maintain the State's central fiscal accounts and order payments into and out of the funds held by him or her, (ii) be responsible for the safekeeping and investment of monies and securities deposited with him or her, and for their disbursement upon his or her order, and (iii) have the duties and powers that may be prescribed by law. No Comptroller or Treasurer shall be elected in 2010 and thereafter. Effective otherwise upon conclusion of the terms of the Comptroller and the Treasurer elected in 2006.

CONSTITUTIONAL AMENDMENT

 
3     RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
4 NINETY-FIFTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE
5 SENATE CONCURRING HEREIN, that there shall be submitted to the
6 electors of the State for adoption or rejection at the general
7 election next occurring at least 6 months after the adoption of
8 this resolution a proposition to amend Article V of the
9 Illinois Constitution by changing Sections 1, 3, 7, and 18 and
10 by repealing Section 17 as follows:

THE EXECUTIVE

13     (ILCON Art. V, Sec. 1)
14 SECTION 1. OFFICERS
15     The Executive Branch shall include a Governor, Lieutenant
16 Governor, Attorney General, Secretary of State, and
17 Comptroller of the Treasury Comptroller and Treasurer elected
18 by the electors of the State. They shall keep the public
19 records and maintain a residence at the seat of government
20 during their terms of office.

1 SECTION 3. ELIGIBILITY
2     To be eligible to hold the office of Governor, Lieutenant
3 Governor, Attorney General, Secretary of State, or Comptroller
4 of the Treasury Comptroller or Treasurer, a person must be a
5 United States citizen, at least 25 years old, and a resident of
6 this State for the three years preceding his or her election.

9 SECTION 7. VACANCIES IN OTHER ELECTIVE OFFICES
10     If the Attorney General, Secretary of State, or Comptroller
11 of the Treasury Comptroller or Treasurer fails to qualify or if
12 the his office becomes vacant, the Governor shall fill the
13 office by appointment. The appointee shall hold office until
14 the elected officer qualifies or until a successor is elected
15 and qualified as may be provided by law and shall not be
16 subject to removal by the Governor. If the Lieutenant Governor
17 fails to qualify or if the his office becomes vacant, it shall
18 remain vacant until the end of the term.

21 SECTION 17. COMPTROLLER - DUTIES (REPEALED)
22     The Comptroller, in accordance with law, shall maintain the
23 State's central fiscal accounts, and order payments into and
24 out of the funds held by the Treasurer.

3 SECTION 18. COMPTROLLER OF THE TREASURY TREASURER - DUTIES
4     The Comptroller of the Treasury Treasurer, in accordance
5 with law, shall (i) maintain the State's central fiscal
6 accounts, and order payments into and out of the funds held by
7 him or her, (ii) be responsible for the safekeeping and
8 investment of monies and securities deposited with him or her,
9 and for their disbursement upon his or her order, and (iii)
10 have the duties and powers that may be prescribed by law of the
11 Comptroller.

SCHEDULE
14     A Comptroller of the Treasury, but not a Comptroller or
15 Treasurer, shall be elected in 2010 and thereafter. This
16 Constitutional Amendment otherwise takes effect upon the
17 conclusion of the terms of the Comptroller and the Treasurer
18 elected in 2006.
