AMENDMENT TO HOUSE BILL 5229

2     AMENDMENT NO. ______. Amend House Bill 5229, AS AMENDED, by
3 replacing paragraph 12 of Sec. 5-710 of Section 5 with the
4 following:
5     "(12) As part of a sentence of probation, conditional
6 discharge, or supervision that may be imposed by the court, a
7 gang member who is a minor who has been found guilty of or
8 continued under supervision for a gang-related offense and who
9 has not previously been been found guilty of or continued under
10 supervision for a gang-related offense shall, upon completion
11 of any term of incarceration, be required: (i) to perform
12 community service, the type and number of hours of community
13 service to be determined by the court; (ii) if the gang member
14 does not have a high school diploma or a GED certificate, to
15 attend and complete educational courses designed to prepare the
16 gang member to pass the high school level Test of General
17 Educational Development (GED), or if the gang member is
18 enrolled in high school to complete high school and attain a

1 high school diploma; and (iii) to comply with a curfew (A)
2 between 10:00 p.m. on Friday and 6:00 a.m. on Saturday; (B)
3 between 10:00 p.m. on Saturday and 6:00 a.m. on Sunday; and (C)
4 between 9:00 p.m. on Sunday to Thursday, inclusive, and 6:00
5 a.m. on the following day. The court shall inform the local law
6 enforcement agency of the jurisdiction where the gang member
7 resides after completion of any term of imprisonment of the
8 curfew imposed on the gang member and shall order that the law
9 enforcement agency conduct random monitoring of the gang member
10 to ensure compliance with the curfew requirements. For the
11 purposes of this paragraph (12), "gang member" and
12 "gang-related" have the meanings ascribed to them in Section 10
13 of the Illinois Streetgang Terrorism Omnibus Prevention Act.".
