SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/16-23 new

    Amends the Criminal Code of 1961. Creates the offense of purchase of stolen scrap metal. Provides that a person commits the offense when he or she purchases scrap metal knowing that the scrap metal has been stolen or converted. Provides that a violation is a Class C misdemeanor for a first offense and a Class B misdemeanor for a second or subsequent offense.

1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Criminal Code of 1961 is amended by adding
5 Section 16-23 as follows:
 
6     (720 ILCS 5/16-23 new)
7     Sec. 16-23. Purchase of stolen scrap metal.
8     (a) Definition. For the purposes of this Section, "scrap
9 metal" means any copper, brass, or aluminum, or any combination
10 of those metals, irrespective of form or quantity, except that
11 "scrap metal" does not include: (i) items designed to contain,
12 or to be used in the preparation of, beverages or food for
13 human consumption; (ii) discarded items of non-commercial or
14 household waste; or (iii) gold, silver, platinum, and other
15 precious metals used in jewelry.
16     (b) A person commits the offense of purchase of stolen
17 scrap metal when he or she purchases scrap metal knowing that
18 the scrap metal has been stolen or converted.
19     (c) Sentence. Purchase of stolen scrap metal is a Class C
20 misdemeanor for a first offense and a Class B misdemeanor for a
21 second or subsequent offense.
