Amends the Radon Industry Licensing Act. Requires the Illinois Emergency Management Agency, in coordination with the Environmental Protection Agency and the Pollution Control Board, to adopt rules for radon control for all new residential buildings. Requires that these rules incorporate the radon control methods set forth in the International Residential Code. Effective immediately.

| AN ACT concerning safety.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Radon Industry Licensing Act is amended by |
5 |
| changing Section 20 as follows:
|
6 |
| (420 ILCS 44/20)
|
7 |
| Sec. 20. General powers.
|
8 |
| (a) The Agency may undertake
projects to determine whether |
9 |
| and to what extent radon and radon progeny are
present in |
10 |
| dwellings and other buildings, to determine to what
extent |
11 |
| their presence constitutes a risk to public health, and to |
12 |
| determine
what measures are effective in reducing and |
13 |
| preventing the risk to public
health.
|
14 |
| (b) In addition
to other powers granted under this Act, the |
15 |
| Agency is authorized to:
|
16 |
| (1) Establish a program for measuring radon or radon |
17 |
| progeny in dwellings
and other buildings.
|
18 |
| (2) Conduct surveys and studies in cooperation with the |
19 |
| Department of
Natural Resources and the Department of |
20 |
| Public Health to determine the
distribution and |
21 |
| concentration of radon or radon progeny in dwellings and
|
22 |
| other buildings and the associated health risk and to |
23 |
| evaluate
measures that may be used to mitigate a present or |
|

| potential health risk.
|

| (3) Enter into dwellings and other buildings with the |
3 |
| consent of the owner
or occupant to engage in monitoring |
4 |
| activities or to conduct remedial action
studies or |
5 |
| programs.
|

| (4) Enter into contracts for projects undertaken |
7 |
| pursuant to subsection
(a).
|
8 |
| (5) Enter into agreements with other departments, |
9 |
| agencies, and
subdivisions of
the federal government, the |
10 |
| State, and units of local government to implement
this Act.
|
11 |
| (6) Establish training and educational programs.
|
12 |
| (7) Apply for, accept, and use grants or other |
13 |
| financial assistance and
accept and use gifts of money or |
14 |
| property to implement this Act.
|
15 |
| (8) Provide technical assistance to persons and to |
16 |
| other State
departments,
agencies, political subdivisions, |
17 |
| units of local government, and
school
districts.
|
18 |
| (9) Prescribe forms for application for a license.
|
19 |
| (10) Establish the minimum qualifications for
a |
20 |
| license, including requirements for examinations or |
21 |
| performance testing, and
issue licenses to persons found to |
22 |
| be qualified.
|
23 |
| (10.5) Investigate any unlicensed activity.
|
24 |
| (11) Conduct hearings or proceedings to revoke, |
25 |
| suspend, or
refuse to
issue
or renew a license, or assess |
26 |
| civil penalties.

| (12) Adopt rules for the administration and
|
2 |
| enforcement of this Act.
|
3 |
| (13) Establish by rule fees to recover the cost of the |
4 |
| program.
|

| (c) The Agency, in coordination with the Environmental |
6 |
| Protection Agency and the Pollution Control Board, shall adopt |
7 |
| rules for radon control for all new residential buildings. |
8 |
| These rules must incorporate the radon control methods set |
9 |
| forth in the International Residential Code appendix as the |
10 |
| model language, with changes necessary to comply with existing |
11 |
| construction codes in the State. |

| Section 99. Effective date. This Act takes effect upon |
14 |
| becoming law.
