SYNOPSIS AS INTRODUCED:
 
225 ILCS 440/4   from Ch. 121, par. 504
225 ILCS 440/4.09 new

    Amends the Highway Advertising Control Act of 1971. Provides that signs advertising or displaying any material permitted by specified provisions of the Act may be incorporated into the concrete of highway bridges for purposes of advertising or providing information. Provides that the Department of Transportation of the State of Illinois shall only permit the sign if it is incorporated into the highway bridge using the concrete as a substrate. Provides that the sign shall not consist of a separate structure that is affixed to the highway bridge by mechanical means. Provides that Department shall also require that any sign created under specified provisions is able to be removed from the concrete and that the concrete be able to be restored to its original condition. Effective July 1, 2008.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Highway Advertising Control Act of 1971 is
5 amended by changing Section 4 and by adding Section 4.09 as
6 follows:
 
7     (225 ILCS 440/4)  (from Ch. 121, par. 504)
8     Sec. 4. Signs shall not be erected or maintained along
9 primary or Interstate highways except those described in
10 Sections 4.01 through 4.09 4.08.

13     Sec. 4.09. Highway bridge advertising.
14     (a) Signs advertising or displaying any material permitted
15 by Sections 4.01 through 4.08 of this Act may be incorporated
16 into the concrete of highway bridges for purposes of
17 advertising or providing information. The Department shall
18 only permit the sign described under this Section if it is
19 incorporated into the highway bridge using the concrete as a
20 substrate.
21     (b) The sign shall not consist of a separate structure that
22 is affixed to the highway bridge by mechanical means.

1     (c) The Department shall also require that any sign created
2 under this Section is be able to be removed from the concrete
3 and that the concrete be able to be restored to its original

5     Section 99. Effective date. This Act takes effect July 1,
6 2008.
