SYNOPSIS AS INTRODUCED:
 
60 ILCS 1/120-10

    Amends the Township Code. Provides that a township may use eminent domain powers to acquire land for park purposes in a township in which a referendum was approved prior to August 18, 2005 authorizing the issuance of bonds for the purchase and improvement of a public park. Effective immediately.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Township Code is amended by changing Section
5 120-10 as follows:
 
6     (60 ILCS 1/120-10)
7     Sec. 120-10. Method of acquiring land.
8     (a) A township desiring to procure lands for park purposes
9 under this Article may purchase the lands from the owner or
10 owners or, in the discretion of the township board, may acquire
11 the lands by the exercise of the power of eminent domain in the
12 manner provided by the laws of this State for taking or
13 damaging private property for public purposes.
14     (b) A township may not utilize eminent domain powers with
15 respect to lands located within the boundaries of a
16 municipality that is served by a municipal recreation
17 department, or a park district. This subsection (b) does not
18 apply to any township in which a referendum was approved under
19 Section 125-10 prior to August 18, 2005.

21     Section 99. Effective date. This Act takes effect upon
22 becoming law.
