SYNOPSIS AS INTRODUCED:
 
415 ILCS 20/3.2 new

    Amends the Illinois Solid Waste Management Act. Provides that school districts in the State shall periodically review their procurement procedures and specifications related to the purchase of products or supplies with the objectives of (1) seeking out products and supplies that contain recycled materials and (2) ensuring that purchased products or supplies are reusable, durable, or made from recycled materials if economically and practically feasible. Provides that public schools shall give preference to products and supplies containing the highest amount of recycled material. Sets forth benchmarks for the public school recycling program through the year 2020. Sets forth recovered material content guidelines for recycled paper. Requires each school board in the State to develop a comprehensive waste reduction plan by July 1, 2010 covering a period of 15 years that addresses the management of solid waste generated by academic, administrative, and other institutional functions. Provides that the comprehensive waste reduction plans shall be updated every 5 years. Provides that each comprehensive waste reduction plan shall provide for recycling of marketable materials present in the school district's waste stream and shall provide for the investigation of potential markets for other recyclable materials present in the school district's waste stream.

1     AN ACT concerning safety.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Solid Waste Management Act is
5 amended by adding Section 3.2 as follows:
 
6     (415 ILCS 20/3.2 new)
7     Sec. 3.2. Public schools.
8     (a) For purposes of this Section, the terms "public
9 school", "school board", and "school district" have the same
10 meaning as provided in Section 1-3 of the School Code.
11     (b) Each school district shall periodically review its
12 procurement procedures and specifications related to the
13 purchase of products or supplies. Those procedures and
14 specifications shall be modified as necessary to require each
15 school district to seek out products and supplies that contain
16 recycled materials, and to ensure that purchased products or
17 supplies are reusable, durable, or made from recycled materials
18 if economically and practically feasible. In selecting
19 products or supplies that contain recycled material,
20 preference shall be given to products and supplies containing
21 the highest amount of recycled material and that are consistent
22 with the effective use of the product or supply.

1 schools shall procure recycled paper and paper products as
2 follows:
3         (1) beginning July 1, 2008, a minimum of 10% of the
4     total dollar value of paper and paper products purchased by
5     public schools shall be recycled paper and recycled paper
6     products;
7         (2) beginning July 1, 2011, a minimum of 25% of the
8     total dollar value of paper and paper products purchased by
9     public schools shall be recycled paper and recycled paper
10     products;
11         (3) beginning July 1, 2014, a minimum of 50% of the
12     total dollar value of paper and paper products purchased by
13     public schools shall be recycled paper and recycled paper
14     products; and
15         (4) beginning July 1, 2020, a minimum of 75% of the
16     total dollar value of paper and paper products purchased by
17     public schools shall be recycled paper and recycled paper
18     products.
19     (d) Recycled paper shall contain at least 50% recovered
20 material. Such recovered material, until July 1, 2008, shall
21 consist of at least 20% deinked stock or postconsumer material;
22 and beginning July 1, 2008, shall consist of at least 25%
23 deinked stock or postconsumer material; and beginning July 1,
24 2010, shall consist of at least 30% deinked stock or
25 postconsumer material; and beginning July 1, 2012, shall
26 consist of at least 40% deinked stock or postconsumer material;

1 and beginning July 1, 2014, shall consist of at least 50%
2 deinked stock or postconsumer materials.
3     (e) By July 1, 2010, each school board shall develop a
4 comprehensive waste reduction plan covering a period of 15
5 years that addresses the management of solid waste generated by
6 academic, administrative, and other institutional functions.
7 The initial comprehensive waste reduction plan required under
8 this subsection shall be updated by each school district every
9 5 years.
10     (f) Each comprehensive waste reduction plan shall provide
11 for recycling of marketable materials that are present in the
12 school district's waste stream at the time the plan is
13 developed or updated, including, but not limited to, landscape
14 waste, corrugated cardboard, computer paper, and white office
15 paper. Each plan shall also provide for the investigation of
16 potential markets for other recyclable materials that are
17 present in the school district's waste stream. The recycling
18 provisions of the comprehensive waste reduction plan shall be
19 designed to achieve, by July 1, 2020, at least a 50% reduction
20 in the amount of solid waste that is generated by each school
21 district and identified by the plan as being subject to
22 landfill disposal.
