SYNOPSIS AS INTRODUCED:
 
55 ILCS 5/5-1129 new
65 ILCS 5/11-15.1-2.1   from Ch. 24, par. 11-15.1-2.1

    Amends the Counties Code and the Illinois Municipal Code. Provides that certain counties are excluded from a provision of the Illinois Municipal Code that provides that property within the county that is covered by an annexation agreement is subject to the ordinances, control, and jurisdiction of the annexing municipality, unless the county board elects to be covered by that provision by a vote of two-thirds of its members.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Counties Code is amended by adding Section
5 5-1129 as follows:
 
6     (55 ILCS 5/5-1129 new)
7     Sec. 5-1129. Annexation agreements. The county board in any
8 county that borders a county referenced in item (ii) or (iii)
9 of subsection (b) of Section 11-15.1-2.1 of the Illinois
10 Municipal Code may, by a vote of two-thirds of its members,
11 elect to be covered under the provisions of Section 11-15.1-2.1
12 of the Illinois Municipal Code.
 
13     Section 10. The Illinois Municipal Code is amended by
14 changing Section 11-15.1-2.1 as follows:
 
15     (65 ILCS 5/11-15.1-2.1)  (from Ch. 24, par. 11-15.1-2.1)
16     Sec. 11-15.1-2.1. Annexation agreement; municipal
17 jurisdiction.
18     (a) Property that is the subject of an annexation agreement
19 adopted under this Division is subject to the ordinances,
20 control, and jurisdiction of the annexing municipality in all
21 respects the same as property that lies within the annexing

1 municipality's corporate limits.
2     (b) This Section shall not apply in (i) a county with a
3 population of more than 3,000,000, (ii) a county that borders a
4 county with a population of more than 3,000,000, or (iii) a
5 county with a population of more than 246,000 according to the
6 1990 federal census and bordered by the Mississippi River, or
7 (iv) a county that borders a county referenced in item (ii) or
8 (iii) of this subsection, unless, in the case of a county
9 referenced in this item (iv), that county has elected to be
10 covered under this Section by a two-thirds vote of the county
11 board. If unless the parties to the annexation agreement have,
12 at the time the agreement is signed, ownership or control of
13 all property that would make the property that is the subject
14 of the agreement contiguous to the annexing municipality, in
15 which case the property that is the subject of the annexation
16 agreement is subject to the ordinances, control, and
17 jurisdiction of the municipality in all respects the same as
18 property owned by the municipality that lies within its
19 corporate limits.
