| AMENDMENT TO HOUSE BILL 2437

| AMENDMENT NO. ______. Amend House Bill 2437 by replacing |

| everything after the enacting clause with the following:
|

| "Section 5. The Illinois Lottery Law is amended by changing |
5 |
| Section 15 and adding Section 27.5 as follows:
|
6 |
| (20 ILCS 1605/15) (from Ch. 120, par. 1165)
|
7 |
| Sec. 15. No person under 21 minor under 18 years of age |
8 |
| shall buy a lottery ticket or
share. No person shall sell, |
9 |
| distribute samples of, or furnish a lottery
ticket or share to |
10 |
| any person under 21 minor under 18 years of age, buy a lottery |
11 |
| ticket or
share for any person under 21 minor under 18 years of |
12 |
| age, or aid and abet in the purchase of
lottery tickets or |
13 |
| shares by a person under 21 minor under 18 years of age.
|
14 |
| No ticket or share shall be purchased by, and no prize |
15 |
| shall be paid to
any of the following persons: any member of |
16 |
| the Board or any officer or
other person employed by the Board |

| or by the Department;
any spouse, child, brother, sister , or |
2 |
| parent residing as a member of the
same household in the |
3 |
| principal place of abode of any such persons; or any
person |
4 |
| under 21 minor under 18 years of age.

| Any
violation of this Section by a person other than the |
6 |
| purchasing person under 21 years of age minor shall be
a Class |
7 |
| B misdemeanor;
provided,
that if any violation of this Section |
8 |
| is a subsequent
violation, the
offender shall be guilty of a |
9 |
| Class 4 felony. Notwithstanding any provision
to the contrary, |
10 |
| a violation of this Section by a person under 21 minor under 18 |
11 |
| years of age
shall be a petty offense.

| Sec. 27.5. No rulemaking authority. Notwithstanding any |
15 |
| other provision of this Act or any other rulemaking authority |
16 |
| that may exist, on and after the effective date of this |
17 |
| amendatory Act of the 95th General Assembly, neither the |
18 |
| Governor nor any agency or agency head under the jurisdiction |
19 |
| of the Governor has any authority to make or promulgate rules |
20 |
| to implement or enforce the provisions of this Act. If, |
21 |
| however, the Governor believes that rules are necessary to |
22 |
| implement or enforce the provisions of this Act, the Governor |
23 |
| may suggest rules to the General Assembly by filing them with |
24 |
| the Clerk of the House and Secretary of the Senate and by |
25 |
| requesting that the General Assembly authorize such rulemaking |

| by law, enact those suggested rules into law, or take any other |
2 |
| appropriate action in the General Assembly's discretion. |
3 |
| Nothing contained in this Act shall be interpreted to grant |
4 |
| rulemaking authority under any other Illinois statute where |
5 |
| such authority is not otherwise explicitly given. For the |
6 |
| purposes of this Act, "rules" is given the meaning contained in |
7 |
| Section 1-70 of the Illinois Administrative Procedure Act, and |
8 |
| "agency" and "agency head" are given the meanings contained in |
9 |
| Sections 1-20 and 1-25 of the Illinois Administrative Procedure |
10 |
| Act to the extent that such definitions apply to agencies or |
11 |
| agency heads under the jurisdiction of the Governor.
|
12 |
| Section 99. Effective date. This Act takes effect upon |
13 |
| becoming law.".
