    Amends the Environmental Protection Act. Makes a technical change in a Section concerning agrichemical facility or lawncare containment permit endorsement.

1     AN ACT concerning safety.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Environmental Protection Act is amended by
5 changing Section 39.4 as follows:
 
6     (415 ILCS 5/39.4)  (from Ch. 111 1/2, par. 1039.4)
7     Sec. 39.4. (a) Upon receipt of a joint application
8 transmitted from the the Department of Agriculture for an
9 agrichemical facility construction or operation permit or a
10 lawncare containment permit, the Agency may provide a written
11 endorsement of the permit to be issued by the Department for
12 such agrichemical facility or lawncare wash water containment
13 area. The Agency's endorsement may be provided at any time
14 prior to final action by the Department regarding the subject
15 permit.
16     (b) For all purposes of this Act, an agrichemical facility
17 permit or lawncare containment permit endorsed by the Agency
18 pursuant to this Section shall be deemed to be a permit issued
19 by the Agency pursuant to subsection (b) of Section 9 and
20 subsection (b) of Section 12 of this Act. An agrichemical
21 facility or a lawncare wash water containment area remains
22 subject to all applicable permit requirements under this Act if
23 the Department of Agriculture's agrichemical facility permit

1 or lawncare containment permit has not been endorsed pursuant
2 to subsection (a) of this Section.
3     (c) An agrichemical facility permit or a lawncare
4 containment permit endorsed by the Agency shall not be subject
5 to the annual fee provisions of Section 9.6 of this Act.
