    Amends the State Finance Act. Changes the names of the Conservation 2000 Fund and Conservation 2000 Projects Fund to the Partners for Conservation Fund and the Partners for Conservation Projects Fund. Authorizes use of funds for planning, preservation, and water protection, to partner with private landowners, government, and not-for-profit organizations, and to pay personnel and other costs. Eliminates the Department of Transportation as authorized to use funds. Authorizes transfers from GRF to the Funds through 2021 (now, 2009).

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The State Finance Act is amended by changing
5 Sections 5.411, 5.412, and 6z-32 as follows:

14     Sec. 6z-32. Partners for Planning and Conservation
15 Conservation 2000.
16     (a) The Partners for Conservation 2000 Fund (formerly known
17 as the Conservation 2000 Fund) and the Partners for
18 Conservation 2000 Projects Fund (formerly known as the
19 Conservation 2000 Projects Fund) are created as special funds
20 in the State Treasury. These funds shall be used to establish a
21 comprehensive program to protect Illinois' natural resources

1 through cooperative partnerships between State government and
2 public and private landowners. Moneys in these Funds may be
3 used, subject to appropriation, by the Department of Natural
4 Resources, Environmental Protection Agency, and the Department
5 Departments of Agriculture, Natural Resources, and
6 Transportation for purposes relating to natural resource
7 protection, planning, recreation, tourism, and compatible
8 agricultural and economic development activities. Without
9 limiting these general purposes, moneys in these Funds may be
10 used, subject to appropriation, for the following specific
11 purposes:
12         (1) To foster sustainable agriculture practices and
13     control soil erosion and sedimentation, including grants
14     to Soil and Water Conservation Districts for conservation
15     practice cost-share grants and for personnel, educational,
16     and administrative expenses.
17         (2) To establish and protect a system of ecosystems in
18     public and private ownership through conservation
19     easements, incentives to public and private landowners,
20     natural resource restoration and preservation, water
21     quality protection and improvement, land use and watershed
22     planning, including technical assistance and grants, and
23     land acquisition provided these mechanisms are all
24     voluntary on the part of the landowner and do not involve
25     the use of eminent domain.
26         (3) To develop a systematic and long-term program to

1     effectively measure and monitor natural resources and
2     ecological conditions through investments in technology
3     and involvement of scientific experts.
4         (4) To initiate strategies to enhance, use, and
5     maintain Illinois' inland lakes through education,
6     technical assistance, research, and financial incentives.
7         (5) To partner with private landowners and with units
8     of State, federal, and local government and with
9     not-for-profit organizations in order to integrate State
10     and federal programs with Illinois' natural resource
11     protection and restoration efforts and to meet
12     requirements to obtain federal and other funds for
13     conservation or protection of natural resources. To
14     conduct an extensive review of existing Illinois water
15     laws.
16         (6) To fund personnel, contractual, professional, or
17     technical services to administer the provisions of this
18     Section.
19     (b) The State Comptroller and State Treasurer shall
20 automatically transfer on the last day of each month, beginning
21 on September 30, 1995 and ending on June 30, 2021 2009, from
22 the General Revenue Fund to the Partners for Conservation 2000
23 Fund, an amount equal to 1/10 of the amount set forth below in
24 fiscal year 1996 and an amount equal to 1/12 of the amount set
25 forth below in each of the other specified fiscal years:

11     (c) Notwithstanding any other provision of law to the
12 contrary and in addition to any other transfers that may be
13 provided for by law, on the last day of each month beginning on
14 July 31, 2006 and ending on June 30, 2007, or as soon
15 thereafter as may be practical, the State Comptroller shall
16 direct and the State Treasurer shall transfer $1,000,000 from
17 the Open Space Lands Acquisition and Development Fund to the
18 Conservation 2000 Fund.
19     (d) There shall be deposited into the Partners for
20 Conservation 2000 Projects Fund such bond proceeds and other
21 moneys as may, from time to time, be provided by law.
