SYNOPSIS AS INTRODUCED:
 
5 ILCS 120/1.02   from Ch. 102, par. 41.02

    Amends the Open Meetings Act. When the majority of a quorum of a public body numbers fewer than 3 members, redefines that public body's "meeting" as a gathering of a quorum for the purpose of communications pertaining to public business. Effective immediately.

1     AN ACT concerning government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Open Meetings Act is amended by changing
5 Section 1.02 as follows:
 
6     (5 ILCS 120/1.02)  (from Ch. 102, par. 41.02)
7     Sec. 1.02. For the purposes of this Act:
8     "Meeting" means any gathering, whether in person or by
9 video or audio conference, telephone call, electronic means
10 (such as, without limitation, electronic mail, electronic
11 chat, and instant messaging), or other means of contemporaneous
12 interactive communication, of (i) a majority of a quorum of the
13 members of a public body held for the purpose of discussing
14 public business, if a majority of a quorum of that public body
15 is 3 or more members, or (ii) a quorum of the members of a
16 public body held for the purpose of communications pertaining
17 to public business, if a majority of a quorum of that public
18 body is fewer than 3 members.
19     "Public body" includes all legislative, executive,
20 administrative or advisory bodies of the State, counties,
21 townships, cities, villages, incorporated towns, school
22 districts and all other municipal corporations, boards,
23 bureaus, committees or commissions of this State, and any

1 subsidiary bodies of any of the foregoing including but not
2 limited to committees and subcommittees which are supported in
3 whole or in part by tax revenue, or which expend tax revenue,
4 except the General Assembly and committees or commissions
5 thereof. "Public body" includes tourism boards and convention
6 or civic center boards located in counties that are contiguous
7 to the Mississippi River with populations of more than 250,000
8 but less than 300,000. "Public body" includes the Health
9 Facilities Planning Board. "Public body" does not include a
10 child death review team or the Illinois Child Death Review
11 Teams Executive Council established under the Child Death
12 Review Team Act or an ethics commission acting under the State
13 Officials and Employees Ethics Act.

15     Section 99. Effective date. This Act takes effect upon
16 becoming law.
