    Amends the Mental Health and Developmental Disabilities Administrative Act.  Requires that the Department of Human Services by rule establish the maximum annual household income for eligibility for the Family Assistance and Support Program, which may not be less than $65,000 and must be adjusted annually for inflation.  Effective immediately.

    AN ACT concerning State government.

    Be it enacted by the People of the State of Illinois,
 
3
represented in the General Assembly:

    Section 5. The Mental Health and Developmental 
5
Disabilities Administrative Act is amended  by changing Section 
6
59 as follows:

    Sec. 59. The Department may create a Family Assistance and 
9
Support
Program to assist families in providing care at home 
10
for persons of any age
with a severe or profound developmental 
11
disability, to prevent or delay the
institutionalization of 
12
such persons or to permit the return of such
persons from 
13
facilities to their families.  As used in this Section,

14
"families" includes foster families.  The program may provide

15
reimbursement for services or other need as specified in this 
16
Section only
if payment or reimbursement for such services is 
17
not available through
insurance or any other State or federal 
18
program.  The Department may
require documentation, where 
19
deemed appropriate by the Department, that
other sources of 
20
payment or reimbursement are not available.  Reimbursement
is 
21
available under the program for special adaptive equipment, 
22
minor
structural modifications to a residence or vehicle, 
23
adaptive clothing,
medications, special dietary needs, and

transportation to special services.
The Department may also 
2
provide reimbursement for any other unusual
expenses necessary 
3
for the maintenance of a person with a severe or profound

4
developmental disability at home.  Reimbursement to any family 
5
in any year
under the program shall not exceed $2,500, except 
6
when the limit
is waived by the Department in cases of 
7
extraordinary need as determined by
the Department in 
8
accordance with rules adopted by the Department.
Expenditures 
9
shall be subject to available appropriations for this program.

The Department shall promulgate rules to implement and 
11
administer the
program and establish criteria to assure 
12
equitable distribution of funds
under this program throughout 
13
the State. The rules must include establishment of the maximum 
14
annual household income for an eligible family, which may not 
15
be less than $65,000 beginning January 1, 2008, and the annual 
16
adjustment for inflation of that income amount as determined by 
17
the Consumer Price Index for All Urban Consumers as determined 
18
by the United States Department of Labor.

    An interim report and evaluation of the program shall be 
20
submitted to the
General Assembly no later than June 30, 1988.  
21
A subsequent interim report and
evaluation of the program shall 
22
be submitted to the General Assembly no
later than January 1, 
23
1989.  The Governor's Planning Council on Developmental

24
Disabilities shall assist the Department in the evaluation of 
25
the program.
