AMENDMENT TO HOUSE BILL 1542

2     AMENDMENT NO. ______. Amend House Bill 1542 immediately
3 below the enacting clause, by inserting the following:
 
4     "Section 3. The Counties Code is amended by changing
5 Sections 2-5009, 2-5011, and 2-5015 as follows:
 
6     (55 ILCS 5/2-5009)  (from Ch. 34, par. 2-5009)
7     Sec. 2-5009. Duties and powers of county executive. Any
8 county executive elected under this Division shall:
9     (a) see that all of the orders, resolutions and regulations
10 of the board are faithfully executed;
11     (b) coordinate and direct by executive order or otherwise
12 all administrative and management functions of the county
13 government except the offices of elected county officers;
14     (c) prepare and submit to the board for its approval the
15 annual budget for the county required by Division 6-1 of this
16 Code;

1     (d) appoint, with the advice and consent of the board,
2 persons to serve on the various boards and commissions to which
3 appointments are provided by law to be made by the board;
4     (e) appoint, with the advice and consent of the board,
5 persons to serve on various special districts within the county
6 except where appointment to serve on such districts is
7 otherwise provided by law;
8     (f) make an annual report to the board on the affairs of
9 the county, on such date and at such time as the board shall
10 designate, and keep the board fully advised as to the financial
11 condition of the county and its future financial needs;
12     (g) appoint, with the advice and consent of the board, such
13 subordinate deputies, employees and appointees for the general
14 administration of county affairs as considered necessary,
15 except those deputies, employees and appointees in the office
16 of an elected county officer;
17     (h) remove or suspend in his discretion, after due notice
18 and hearing, anyone whom he has the power to appoint;
19     (i) require reports and examine accounts, records and
20 operations of all county administrative units;
21     (j) supervise the care and custody of all county property
22 including institutions and agencies;
23     (k) approve or veto ordinances or resolutions pursuant to
24 Section 2-5010;
25     (l) preside over board meetings; however, the county
26 executive is not entitled to vote except to break a tie vote;

1     (m) call a special meeting of the county board, by a
2 written executive order signed by him and upon 24 hours notice
3 by delivery of a copy of such order to the residence of each
4 board member;
5     (n) with the advice and consent of the county board, enter
6 into intergovernmental agreements with other governmental
7 units;
8     (o) with the advice and consent of the county board,
9 negotiate on behalf of the county with governmental units and
10 the private sector for the purpose of promoting economic growth
11 and development;
12     (p) at his discretion, appoint a person to serve as legal
13 counsel at an annual salary established by the county board at
14 an amount no greater than the annual salary of the state's
15 attorney of the county;
16     (q) appoint, with the advice and consent of the board, all
17 department heads for any county departments; and
18     (r) (q) perform such other duties as shall be required of
19 him by the board.

22     Sec. 2-5011. Death, resignation or inability of county
23 executive. In case of the death, resignation or other inability
24 of the county executive to act, the board shall select a
25 person, from the same political party as the county executive,

1 who is qualified under Section 2-5008 to serve as the interim
2 county executive until the next general election.

5     Sec. 2-5015. Superseding plan for election of county board
6 chairman. The adoption of the county executive form of
7 government by any county pursuant to this Division shall
8 supersede any plan adopted by the county board of that county
9 pursuant to Section 2-3007, as now or hereafter amended, for
10 the election of the chairman of the county board by the voters
11 of the county. No officer of the county board may identify
12 himself or herself as a county chairman or any other title that
13 could conflict with the duties of the County Executive as
14 defined in this Division.
