Amends the Criminal Code of 1961. Creates the offense of sexual battery. Provides that a person commits the offense when he or she intentionally or knowingly without legal justification makes physical contact with the intimate body parts of a victim who was 17 years of age or older at the time of the commission of the offense, without that person's consent. Defines intimate body parts. Provides that a violation is a Class A misdemeanor. Effective immediately.

| AN ACT concerning criminal law.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Criminal Code of 1961 is amended by adding |
5 |
| Section 12-16.3 as follows: |

| (720 ILCS 5/12-16.3 new) |

| Sec. 12-16.3. Sexual battery. |

| (a) A person commits the offense of sexual battery when he |
9 |
| or she intentionally or knowingly without legal justification |
10 |
| makes physical contact with the intimate body parts of a victim |
11 |
| who was 17 years of age or older at the time of the commission |
12 |
| of the offense, without that person's consent. |
13 |
| (b) For purposes of this Section, "intimate body parts" |
14 |
| includes the primary genital area, anus, groin, inner thighs, |
15 |
| buttocks, or breasts of a male or female. |
16 |
| (c) Sentence. Sexual battery is a Class A misdemeanor.

| Section 99. Effective date. This Act takes effect upon |
18 |
| becoming law.
