SYNOPSIS AS INTRODUCED:
 
415 ILCS 5/3.485   was 415 ILCS 5/3.47

    Amends the Environmental Protection Act. Provides that a "storage site" does not include a site that stores non-putrescrible solid wastes in containers for 10 calendar days or less for further transfer to a facility on a non-contagious site.

1     AN ACT concerning safety.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Environmental Protection Act is amended by
5 changing Section 3.485 as follows:
 
6     (415 ILCS 5/3.485)  (was 415 ILCS 5/3.47)
7     Sec. 3.485. Storage site. "Storage site" is a site at which
8 waste is stored. "Storage site" includes transfer stations but
9 does not include (i) a site that accepts or receives waste in
10 transfer containers unless the waste is removed from the
11 transfer container or unless the transfer container becomes
12 stationary, en route to a disposal, treatment, or storage
13 facility for more than 5 business days, or (ii) a site that
14 accepts or receives open top units containing only clean
15 construction and demolition debris, or (iii) a site that stores
16 waste on a refuse motor vehicle or in the vehicle's detachable
17 refuse receptacle for no more than 24 hours, excluding
18 Saturdays, Sundays, and holidays, but only if the detachable
19 refuse receptacle is completely covered or enclosed and is
20 stored on the same site as the refuse motor vehicle that
21 transported the receptacle to the site, or (iv) a site that
22 stores non-putrescrible solid wastes in containers for 10
23 calendar days or less for temporary storage and consolidation

1 and for further transfer to a recycling, disposal, treatment,
2 or storage facility on a non-contagious site.
3     Nothing in this Section shall be construed to be less
4 stringent than or inconsistent with the provisions of the
5 federal Resource Conservation and Recovery Act of 1976 (P.L.
6 94-480) or regulations adopted under it.
