| AN ACT concerning energy efficiency.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 1. Short title. This Act may be cited as the Agency |
5 |
| Energy Efficiency Act. |
6 |
| Section 5. Legislative findings; purpose. The State |
7 |
| government is one of the largest consumers of energy in the |
8 |
| State. As a result, the General Assembly finds that: |
9 |
| (1) a 10% reduction in energy use by all State agencies |
10 |
| would result in a decreased demand on the citizens of the |
11 |
| State; |
12 |
| (2) the use of energy for electricity, heating, and cooling |
13 |
| of State buildings and transportation in State vehicles has a |
14 |
| significant impact on public health and the environment; and |
15 |
| (3) State agencies should set a strong example in energy |
16 |
| efficiency, water conservation, recycling, and waste reduction |
17 |
| to demonstrate cost-effective solutions to citizens, |
18 |
| businesses, and other government jurisdictions. |
19 |
| Section 10. Energy use; goal. All executive branch State |
20 |
| agencies shall make it a goal to reduce energy use in State |
21 |
| facilities by 10% within 10 years after the effective date of |
22 |
| this Act. |

| Section 15. Administration. All State agencies shall work |
2 |
| with the Department of Central Management Services in achieving |
3 |
| the goal set out in Section 10. The Department shall: |
4 |
| (1) ensure that all existing State energy efficiency |
5 |
| measures are achieved; |
6 |
| (2) provide State agencies with the technical |
7 |
| expertise necessary to implement policies adopted under |
8 |
| this Act; |
9 |
| (3) implement an energy information system to measure |
10 |
| progress toward the goal set out in Section 10; and |
11 |
| (4) report to the Governor on a quarterly basis, |
12 |
| beginning January 2008, regarding the progress on |
13 |
| implementing the policies of this Act and achieving the |
14 |
| goal set out in Section 10. |

| For purposes of this Act, "Department" means the Department |
16 |
| of Central Management Services. |
17 |
| Section 20. Construction contracts. All requests for new |
18 |
| construction or renovation to State facilities shall implement |
19 |
| design criteria that exceeds contemporary standards for energy |
20 |
| efficiency. Energy efficiency and waste reduction shall be |
21 |
| considered when evaluating bids submitted for new construction |
22 |
| or renovation projects. |

| Section 25. Agency duties. All executive branch State |

| agencies shall: |
2 |
| (1) implement an energy information system to track its |
3 |
| energy and water usage; |
4 |
| (2) purchase Energy Star equipment, including air |
5 |
| conditioners, computers, appliances, and office equipment, |
6 |
| unless justification is provided and the Department |
7 |
| approves a waiver of this requirement; and |
8 |
| (3) form an internal committee to assess the |
9 |
| environmental impacts of that agency's activities and |
10 |
| identify practical alternatives for incorporating |
11 |
| pollution prevention and resource conservation into agency |
12 |
| management and operational practices. Each internal |
13 |
| committee shall consist of representatives from different |
14 |
| departments and program areas of the agency, including |
15 |
| purchasing, maintenance, and facility management. |
16 |
| A chairperson shall be appointed to coordinate the internal |
17 |
| committee's activities and act as liaison to the Department. |
18 |
| The chairperson shall report to the Department, on a quarterly |
19 |
| basis beginning December 2007, regarding the progress on |
20 |
| implementing the policies of this Act and achieving the goal |
21 |
| set out in Section 10. |

| Section 30. Termination. On or before January 1, 2009, the |
23 |
| Department shall evaluate the reports submitted by each |
24 |
| executive branch State agency and determine whether the costs |
25 |
| of implementing the provisions of this Act exceed the energy |
