AMENDMENT TO HOUSE BILL 1330

2     AMENDMENT NO. ______. Amend House Bill 1330 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The School Code is amended by adding Section
5 2-3.142 and by changing Section 10-22.39 as follows:
 
6     (105 ILCS 5/2-3.142 new)
7     Sec. 2-3.142. The Ensuring Success in School Task Force.
8     (a) In this Section:
9     "Domestic violence organization" or "sexual violence
10 organization" means a nonprofit, nongovernmental organization
11 that provides assistance to victims of domestic or sexual
12 violence or to advocates for such victims, including an
13 organization carrying out a domestic or sexual violence
14 program; an organization operating a shelter or a rape crisis
15 center or providing counseling services; or an organization
16 that seeks to eliminate domestic or sexual violence through

1 legislative advocacy or policy change, public education, or
2 service collaboration.
3     "Domestic violence" means abuse by a family or household
4 member, as "abuse" and "family or household members" are
5 defined in Section 103 of the Illinois Domestic Violence Act of
6 1986.
7     "Expectant parent" means a female who is pregnant or a male
8 who voluntarily identifies himself as the parent of an unborn
9 child by seeking services for teen parents and who has not yet
10 graduated from secondary school as provided in Section 22-22 of
11 this Code.
12     "Parent" means a person who is a custodial parent or a
13 noncustodial parent taking an active role in the care and
14 supervision of a child and who has not yet graduated from
15 secondary school as provided in Section 22-22 of this Code,
16 unless the context otherwise requires.
17     "Sexual violence" means sexual assault, abuse, or stalking
18 of an adult or minor child proscribed in the Criminal Code of
19 1961 in Sections 12-7.3, 12-7.4, 12-7.5, 12-12, 12-13, 12-14,
20 12-14.1, 12-15, and 12-16, including sexual violence committed
21 by perpetrators who are strangers to the victim and sexual
22 violence committed by perpetrators who are known or related by
23 blood or marriage to the victim.
24     "Student" means any youth enrolled, eligible to enroll, or
25 previously enrolled in a school who has not yet graduated from
26 secondary school as provided in Section 22-22 of this Code.

1     "Victim" means an individual who has been subjected to one
2 or more acts of domestic or sexual violence.
3     "Youth", except as otherwise provided in this Code, means a
4 child, student, or juvenile below the age of 21 years who has
5 not yet completed his or her prescribed course of study or has
6 not graduated from secondary school as provided in Section
7 22-22 of this Code. "Youth" includes, but is not limited to,
8 unaccompanied youth not in the physical custody of a parent or
9 guardian.
10     (b) The State Board of Education shall convene an Ensuring
11 Success in School Task Force to develop policies, procedures,
12 and protocols to be adopted by school districts for addressing
13 the educational and related needs of children and youth who are
14 parents, expectant parents, or victims of domestic or sexual
15 violence to ensure their ability to stay in school, stay safe
16 while in school, and successfully complete their education. The
17 State Board of Education shall be the agency responsible for
18 providing staff and administrative support to the task force.
19     (c) The Ensuring Success in School Task Force shall do all
20 of the following:
21         (1) Conduct a thorough examination of the barriers to
22     school attendance, safety, and completion for children and
23     youth who are parents, expectant parents, or victims of
24     domestic or sexual violence.
25         (2) Conduct a discovery process that includes relevant
26     research and the identification of effective policies,

1     protocols, and programs within this State and elsewhere.
2         (3) Conduct meetings and public hearings in
3     geographically diverse locations throughout the State to
4     ensure the maximum input from area advocates and service
5     providers, from local education agencies, and from
6     children and youth who are parents, expectant parents, or
7     victims of domestic or sexual violence and their parents or
8     guardians.
9         (4) Establish and adhere to procedures and protocols to
10     allow children and youth who are parents, expectant
11     parents, or victims of domestic or sexual violence, their
12     parents or guardians, and advocates who work on behalf of
13     such children and youth to participate in the task force
14     anonymously and confidentially.
15         (5) Invite the testimony of and confer with experts on
16     relevant topics.
17         (6) Produce a report of the task force's findings on
18     best practices and policies, which shall include a plan
19     with a phased and prioritized implementation timetable
20     with focus on ensuring the successful and safe completion
21     of school for children and youth who are parents, expectant
22     parents, or victims of domestic or sexual violence. The
23     task force shall submit a report to the General Assembly on
24     or before January 1, 2009 on its findings, recommendations,
25     and implementation plan. Any task force reports shall be
26     published on the State Board of Education's Internet

1     website on the date the report is delivered to the General
2     Assembly.
3         (7) Recommend new legislation or proposed rules
4     developed by the task force.
5     (d) The President of the Senate and the Speaker of the
6 House of Representatives shall each appoint one co-chairperson
7 of the Ensuring Success in School Task Force. In addition to
8 the 2 co-chairpersons, the task force shall be comprised of
9 each of the following members, appointed by the State Board of
10 Education, and shall be representative of the geographic,
11 racial, ethnic, and cultural diversity of this State:
12         (1) A representative of a statewide nonprofit,
13     nongovernmental domestic violence organization.
14         (2) A domestic violence victims' advocate or service
15     provider from a different nonprofit, nongovernmental
16     domestic violence organization.
17         (3) A representative of a statewide nonprofit,
18     nongovernmental sexual assault organization.
19         (4) A sexual assault victims' advocate or service
20     provider from a different nonprofit, nongovernmental
21     sexual assault organization.
22         (5) A teen parent advocate or service provider from a
23     nonprofit, nongovernmental organization.
24         (6) A school social worker.
25         (7) A school psychologist.
26         (8) A school counselor.

1         (9) A representative of a statewide professional
2     teachers' organization.
3         (10) A representative of a different statewide
4     professional teachers' organization.
5         (11) A representative of a statewide organization that
6     represents school boards.
7         (12) A representative of a statewide organization
8     representing principals.
9         (13) A representative of City of Chicago School
10     District 299.
11         (14) A representative of a nonprofit, nongovernmental
12     youth services provider.
13         (15) A representative of a statewide nonprofit,
14     nongovernmental multi-issue advocacy organization with
15     expertise in a cross-section of relevant issues.
16         (16) An alternative education service provider.
17         (17) A representative from a regional office of
18     education.
19         (18) A truancy intervention services provider.
20         (19) A youth who is a parent or expectant parent
21     directly affected by the issues, problems, and concerns of
22     staying in school and successfully completing his or her
23     education through high school.
24         (20) A youth who is a victim of domestic or sexual
25     violence directly affected by the issues, problems, and
26     concerns of staying in school and successfully completing

1     his or her education.
2         (21) A parent or guardian of a child or youth who is a
3     parent or expectant parent directly affected by the issues,
4     problems, and concerns of staying in school and
5     successfully completing his or her education.
6         (22) A parent or guardian of a child or youth who is a
7     victim of domestic or sexual violence directly affected by
8     the issues, problems, and concerns of staying in school and
9     successfully completing his or her education.
10 The task force shall also consist of the State Superintendent
11 of Education, the Secretary of Human Services, the Director of
12 Healthcare and Family Services, the Director of Children and
13 Family Services, and the Director of Public Health or their
14 designees.
15     (e) Members of the Ensuring Success in School Task Force
16 shall receive no compensation for their participation, but may
17 be reimbursed by the State Board of Education for expenses in
18 connection with their participation, including travel, if
19 funds are available. However, members of the task force who are
20 youth who are parents, expectant parents, or victims of
21 domestic or sexual violence and the parents or guardians of
22 such youth shall be reimbursed for their travel expenses
23 connected to their participation in the task force.

25     Sec. 10-22.39. In-service training programs.

1     (a) To conduct in-service training programs for teachers.
2     (b) In addition to other topics at in-service training such
3 programs, school guidance counselors, teachers and other
4 school personnel who work with pupils in grades 7 through 12
5 shall be trained to identify the warning signs of suicidal
6 behavior in adolescents and teens and shall be taught
7 appropriate intervention and referral techniques.
8     (c) School guidance counselors, nurses, teachers and other
9 school personnel who work with pupils may be trained to have a
10 basic knowledge of matters relating to acquired
11 immunodeficiency syndrome (AIDS), including the nature of the
12 disease, its causes and effects, the means of detecting it and
13 preventing its transmission, and the availability of
14 appropriate sources of counseling and referral, and any other
15 information that may be appropriate considering the age and
16 grade level of such pupils. The School Board shall supervise
17 such training. The State Board of Education and the Department
18 of Public Health shall jointly develop standards for such
19 training.
20     (d) In this subsection (d):
21     "Domestic violence" means abuse by a family or household
22 member, as "abuse" and "family or household members" are
23 defined in Section 103 of the Illinois Domestic Violence Act of
24 1986.
25     "Expectant parent" means a female who is pregnant or a male

17 blood or marriage to the victim.
18     "Student" or "pupil" means any youth enrolled, eligible to
19 enroll, or previously enrolled in a school who has not yet
20 graduated from secondary school as provided in Section 22-22 of
21 this Code.

5     At least once every 2 years, an in-service training program
6 for school personnel who work with pupils, including, but not
7 limited to, school and school district administrators,
8 teachers, school guidance counselors, school social workers,
9 school counselors, school psychologists, and school nurses,
10 must be conducted by persons with expertise in domestic and
11 sexual violence and the needs of expectant and parenting youth
12 and shall include training concerning (i) communicating with
13 and listening to youth victims of domestic or sexual violence
14 and expectant and parenting youth, (ii) connecting youth
15 victims of domestic or sexual violence and expectant and
16 parenting youth to appropriate in-school services and other
17 agencies, programs, and services as needed, and (iii)
18 implementing the school district's policies, procedures, and
19 protocols with regard to such youth, including
20 confidentiality. At a minimum, school personnel must be trained
21 to understand, provide information and referrals, and address
22 issues pertaining to youth who are parents, expectant parents,
23 or victims of domestic or sexual violence.
