1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by adding Section
5 2-3.142 and by changing Section 10-22.39 as follows:
 
6     (105 ILCS 5/2-3.142 new)
7     Sec. 2-3.142. The Ensuring Success in School Task Force.
8     (a) In this Section:
9     "Domestic violence" means abuse by a family or household
10 member, as "abuse" and "family or household members" are
11 defined in Section 103 of the Illinois Domestic Violence Act of
12 1986.
13     "Sexual violence" means sexual assault, abuse, or stalking
14 of an adult or minor child proscribed in the Criminal Code of
15 1961 in Sections 12-7.3, 12-7.4, 12-7.5, 12-12, 12-13, 12-14,
16 12-14.1, 12-15, and 12-16, including sexual violence committed
17 by perpetrators who are strangers to the victim and sexual
18 violence committed by perpetrators who are known or related by
19 blood or marriage to the victim.
20     (b) The State Board of Education shall convene an Ensuring
21 Success in School Task Force to develop policies, procedures,
22 and protocols to be adopted by school districts for addressing
23 the educational and related needs of children and youth who are

1 parents, expectant parents, or victims of domestic or sexual
2 violence to ensure their ability to stay in school, stay safe
3 while in school, and successfully complete their education. The
4 State Board of Education shall be the agency responsible for
5 providing staff and administrative support to the task force.
6     (c) The Ensuring Success in School Task Force shall do all
7 of the following:
8         (1) Conduct a thorough examination of the barriers to
9     school attendance, safety, and completion for children and
10     youth who are parents, expectant parents, or victims of
11     domestic or sexual violence.
12         (2) Conduct a discovery process that includes relevant
13     research and the identification of effective policies,
14     protocols, and programs within this State and elsewhere.
15         (3) Conduct meetings and public hearings in
16     geographically diverse locations throughout the State to
17     ensure the maximum input from area advocates and service
18     providers, from local education agencies, and from
19     children and youth who are parents, expectant parents, or
20     victims of domestic or sexual violence and their parents or
21     guardians.
22         (4) Establish and adhere to procedures and protocols to
23     allow children and youth who are parents, expectant
24     parents, or victims of domestic or sexual violence, their
25     parents or guardians, and advocates who work on behalf of
26     such children and youth to participate in the task force

1     anonymously and confidentially.
2         (5) Invite the testimony of and confer with experts on
3     relevant topics.
4         (6) Produce a report of the task force's findings on
5     best practices and policies, which shall include a plan
6     with a phased and prioritized implementation timetable
7     with focus on ensuring the successful and safe completion
8     of school for children and youth who are parents, expectant
9     parents, or victims of domestic or sexual violence. The
10     task force shall submit a report to the General Assembly on
11     or before January 1, 2009 on its findings, recommendations,
12     and implementation plan. Any task force reports shall be
13     published on the State Board of Education's Internet
14     website on the date the report is delivered to the General
15     Assembly.
16         (7) Recommend new legislation or proposed rules
17     developed by the task force.
18     (d) The President of the Senate and the Speaker of the
19 House of Representatives shall each appoint one co-chairperson
20 of the Ensuring Success in School Task Force. In addition to
21 the 2 co-chairpersons, the task force shall be comprised of
22 each of the following members, appointed by the State Board of
23 Education, and shall be representative of the geographic,
24 racial, ethnic, and cultural diversity of this State:
25         (1) A representative of a statewide nonprofit,
26     nongovernmental domestic violence organization.

1         (2) A domestic violence victims' advocate or service
2     provider from a different nonprofit, nongovernmental
3     domestic violence organization.
4         (3) A representative of a statewide nonprofit,
5     nongovernmental sexual assault organization.
6         (4) A sexual assault victims' advocate or service
7     provider from a different nonprofit, nongovernmental
8     sexual assault organization.
9         (5) A teen parent advocate or service provider from a
10     nonprofit, nongovernmental organization.
11         (6) A school social worker.
12         (7) A school psychologist.
13         (8) A school counselor.
14         (9) A representative of a statewide professional
15     teachers' organization.
16         (10) A representative of a different statewide
17     professional teachers' organization.
18         (11) A representative of a statewide organization that
19     represents school boards.
20         (12) A representative of a statewide organization
21     representing principals.
22         (13) A representative of City of Chicago School
23     District 299.
24         (14) A representative of a nonprofit, nongovernmental
25     youth services provider.
26         (15) A representative of a statewide nonprofit,

1     nongovernmental multi-issue advocacy organization with
2     expertise in a cross-section of relevant issues.
3         (16) An alternative education service provider.
4         (17) A representative from a regional office of
5     education.
6         (18) A truancy intervention services provider.
7         (19) A youth who is a parent or expectant parent
8     directly affected by the issues, problems, and concerns of
9     staying in school and successfully completing his or her
10     education through high school.
11         (20) A youth who is a victim of domestic or sexual
12     violence directly affected by the issues, problems, and
13     concerns of staying in school and successfully completing
14     his or her education.
15         (21) A parent or guardian of a child or youth who is a
16     parent or expectant parent directly affected by the issues,
17     problems, and concerns of staying in school and
18     successfully completing his or her education.
19         (22) A parent or guardian of a child or youth who is a
20     victim of domestic or sexual violence directly affected by
21     the issues, problems, and concerns of staying in school and
22     successfully completing his or her education.
23 The task force shall also consist of one member appointed by
24 the Minority Leader of the Senate, one member appointed by the
25 Minority Leader of the House of Representatives, the State
26 Superintendent of Education, the Secretary of Human Services,

1 the Director of Healthcare and Family Services, the Director of
2 Children and Family Services, and the Director of Public Health
3 or their designees.
4     (e) Members of the Ensuring Success in School Task Force
5 shall receive no compensation for their participation, but may
6 be reimbursed by the State Board of Education for expenses in
7 connection with their participation, including travel, if
8 funds are available. However, members of the task force who are
9 youth who are parents, expectant parents, or victims of
10 domestic or sexual violence and the parents or guardians of
11 such youth shall be reimbursed for their travel expenses
12 connected to their participation in the task force.

14     Sec. 10-22.39. In-service training programs.
15     (a) To conduct in-service training programs for teachers.
16     (b) In addition to other topics at in-service training such
17 programs, school guidance counselors, teachers and other
18 school personnel who work with pupils in grades 7 through 12
19 shall be trained to identify the warning signs of suicidal
20 behavior in adolescents and teens and shall be taught
21 appropriate intervention and referral techniques.
22     (c) School guidance counselors, nurses, teachers and other
23 school personnel who work with pupils may be trained to have a
24 basic knowledge of matters relating to acquired
25 immunodeficiency syndrome (AIDS), including the nature of the

1 disease, its causes and effects, the means of detecting it and
2 preventing its transmission, and the availability of
3 appropriate sources of counseling and referral, and any other
4 information that may be appropriate considering the age and
5 grade level of such pupils. The School Board shall supervise
6 such training. The State Board of Education and the Department
7 of Public Health shall jointly develop standards for such
8 training.
9     (d) In this subsection (d):
10     "Domestic violence" means abuse by a family or household
11 member, as "abuse" and "family or household members" are
12 defined in Section 103 of the Illinois Domestic Violence Act of
13 1986.
14     "Sexual violence" means sexual assault, abuse, or stalking
15 of an adult or minor child proscribed in the Criminal Code of
16 1961 in Sections 12-7.3, 12-7.4, 12-7.5, 12-12, 12-13, 12-14,
17 12-14.1, 12-15, and 12-16, including sexual violence committed
18 by perpetrators who are strangers to the victim and sexual
19 violence committed by perpetrators who are known or related by
20 blood or marriage to the victim.
21     At least once every 2 years, an in-service training program
22 for school personnel who work with pupils, including, but not
23 limited to, school and school district administrators,
24 teachers, school guidance counselors, school social workers,
25 school counselors, school psychologists, and school nurses,
26 must be conducted by persons with expertise in domestic and

1 sexual violence and the needs of expectant and parenting youth
2 and shall include training concerning (i) communicating with
3 and listening to youth victims of domestic or sexual violence
4 and expectant and parenting youth, (ii) connecting youth
5 victims of domestic or sexual violence and expectant and
6 parenting youth to appropriate in-school services and other
7 agencies, programs, and services as needed, and (iii)
8 implementing the school district's policies, procedures, and
9 protocols with regard to such youth, including
10 confidentiality. At a minimum, school personnel must be trained
11 to understand, provide information and referrals, and address
12 issues pertaining to youth who are parents, expectant parents,
13 or victims of domestic or sexual violence.

15     Section 99. Effective date. This Act takes effect upon
16 becoming law.
