1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by changing
5 Section 12-815 as follows:
 
6     (625 ILCS 5/12-815)  (from Ch. 95 1/2, par. 12-815)
7     Sec. 12-815. Strobe lamp on school bus.
8     (a) A school bus manufactured prior to January 1, 2000 may
9 be equipped with one strobe lamp that will emit 60 to 120
10 flashes per minute of white or bluish-white light visible to a
11 motorist approaching the bus from any direction. A school bus
12 manufactured on or after January 1, 2000 shall be equipped with
13 one strobe lamp that will emit 60 to 120 flashes per minute of
14 white or bluish-white light visible to a motorist approaching
15 the bus from any direction. The lamp shall be of sufficient
16 brightness to be visible in normal sunlight when viewed
17 directly from a distance of at least one mile.
18     (b) The strobe lamp shall be mounted on the rooftop of the
19 bus with the light generating element in the lamp located
20 equidistant from each side and either at or behind the center
21 of the rooftop. The maximum height of the element above the
22 rooftop shall not exceed 1/30 of its distance from the rear of
23 the rooftop. If the structure of the strobe lamp obscures the

1 light generating element, the element shall be deemed to be in
2 the center of the lamp with a maximum height 1/4 inch less than
3 the maximum height of the strobe lamp unless otherwise
4 indicated in rules and regulations promulgated by the
5 Department. The Department may promulgate rules and
6 regulations to govern measurements, glare, effectiveness and
7 protection of strobe lamps on school buses, including higher
8 strobe lamps than authorized in this paragraph.
9     (c) The strobe lamp may be lighted only when the school bus
10 is actually being used as a school bus and:
11         1. is stopping or stopped for loading or discharging
12     pupils on a highway outside an urban area; or
13         2. is bearing one or more pupils. and is either stopped
14     or, in the interest of safety, is moving very slowly at a
15     speed:
16             (i) less than the posted minimum speed limit, or
17             (ii) less than 30 miles per hour on a highway
18         outside an urban area.

20     Section 99. Effective date. This Act takes effect upon
21 becoming law.
