AMENDMENT TO HOUSE BILL 1040

2     AMENDMENT NO. ______. Amend House Bill 1040 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Illinois Lottery Law is amended by changing
5 Sections 2 and 20 and by adding Section 21.9 as follows:
 
6     (20 ILCS 1605/2)  (from Ch. 120, par. 1152)
7     Sec. 2. This Act is enacted to implement and establish
8 within the State a lottery to be operated by the State, the
9 entire net proceeds of which are to be used for the support of
10 the State's Common School Fund, except as provided in Sections
11 21.2, 21.5, 21.6, and 21.7, 21.8, and 21.9 and 21.7.

1     Sec. 20. State Lottery Fund.
2     (a) There is created in the State Treasury a special fund
3 to be known as the "State Lottery Fund". Such fund shall
4 consist of all revenues received from (1) the sale of lottery
5 tickets or shares, (net of commissions, fees representing those
6 expenses that are directly proportionate to the sale of tickets
7 or shares at the agent location, and prizes of less than $600
8 which have been validly paid at the agent level), (2)
9 application fees, and (3) all other sources including moneys
10 credited or transferred thereto from any other fund or source
11 pursuant to law. Interest earnings of the State Lottery Fund
12 shall be credited to the Common School Fund.
13     (b) The receipt and distribution of moneys under Section
14 21.5 of this Act shall be in accordance with Section 21.5.
15     (c) The receipt and distribution of moneys under Section
16 21.6 of this Act shall be in accordance with Section 21.6.
17     (d) The receipt and distribution of moneys under Section
18 21.7 of this Act shall be in accordance with Section 21.7.
19     (e) (d) The receipt and distribution of moneys under
20 Section 21.8 21.7 of this Act shall be in accordance with
21 Section 21.8 21.7.
22     (d) The receipt and distribution of moneys under Section
23 21.9 of this Act shall be in accordance with Section 21.9.

1     (20 ILCS 1605/21.9 new)
2     Sec. 21.9. Go For The Gold scratch-off game.
3     (a) The Department shall offer a special instant
4 scratch-off game with the title of "Go For The Gold". The game
5 must commence on July 1, 2008 or as soon thereafter, at the
6 discretion of the Director, as is reasonably practical. The
7 operation of the game is governed by this Act and by any rules
8 adopted by the Department. If any provision of this Section is
9 inconsistent with any other provision of this Act, then this
10 Section governs.
11     (b) The net revenue from the Go For The Gold special
12 instant scratch-off game must be deposited into the Special
13 Olympics Illinois Fund for appropriation by the General
14 Assembly solely to the Department of Human Services, which must
15 distribute the moneys to Special Olympics Illinois to support
16 the statewide training, competitions, and programs for present
17 and future Special Olympics athletes. The moneys may not be
18 used for institutional, organizational, or community-based
19 overhead costs, indirect costs, or levies.
20     Moneys received for the purposes of this Section,
21 including, without limitation, net revenue from the special
22 instant scratch-off game and gifts, grants, and awards from any
23 public or private entity, must be deposited into the Fund. Any
24 interest earned on moneys in the Fund must be deposited into
25 the Fund.

1     For purposes of this subsection, "net revenue" means the
2 total amount for which tickets have been sold less the sum of
3 the amount paid out in prizes and the actual administrative
4 expenses of the Department solely related to the Go For The
5 Gold game.
6     (c) During the time that tickets are sold for the Go For
7 The Gold game, the Department shall not unreasonably diminish
8 the efforts devoted to marketing any other instant scratch-off
9 lottery game.
10     (d) The Department may adopt any rules necessary to
11 implement and administer the provisions of this Section.
 
12     Section 99. Effective date. This Act takes effect upon
13 becoming law.".
