SYNOPSIS AS INTRODUCED:

    Amends the Township Code, the Municipal Code, and the Fire Protection District Act. Provides that townships, municipalities, and fire protection districts may fix, charge, and collect reasonable fees from certain parties for providing specialized rescue services. Defines "specialized rescue services".

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Township Code is amended by adding Section
5 14a as follows:
 
6     (60 ILCS 1/14a new)
7     Sec. 14a. Reimbursement for specialized rescue services. A
8 township that provides fire protection services may fix,
9 charge, and collect reasonable fees for specialized rescue
10 services provided by the township. The total amount collected
11 may not exceed the reasonable cost of providing those
12 specialized rescue services and may include an hourly rate per
13 vehicle, an hourly rate per firefighter, and the cost of
14 materials. The fee may be charged to the following parties:
15         (a) the owner of the property on which the specialized
16     rescue services occurred;
17         (b) any person involved in an activity that caused or
18     contributed to the emergency;
19         (c) an individual who is rescued during the emergency
20     and his or her employer if the person was acting in
21     furtherance of the employer's interests;
22         (d) in cases involving the recovery of property, any
23     person having control or custody of the property at the

1     time of the emergency.
2     For the purposes of this Section, the term "specialized
3 rescue services" includes, but is not limited to, structural
4 collapse, tactical rescue, high angle rescue, underwater
5 rescue and recovery, confined space rescue, below grade rescue,
6 and trench rescue.
 
7     Section 10. The Illinois Municipal Code is amended by
8 adding Section 11-6-5 as follows:
 
9     (65 ILCS 5/11-6-5 new)
10     Sec. 11-6-5. Reimbursement for specialized rescue
11 services. The corporate authorities of a municipality that
12 operates a fire department may fix, charge, and collect
13 reasonable fees for specialized rescue services provided by the
14 department. The total amount collected may not exceed the
15 reasonable cost of providing those specialized rescue services
16 and may include an hourly rate per vehicle, an hourly rate per
17 firefighter, and the cost of materials. The fees may be charged
18 to the following parties:
19         (a) the owner of the property on which the specialized
20     rescue services occurred;
21         (b) any person involved in an activity that caused or
22     contributed to the emergency;
23         (c) an individual who is rescued during the emergency
24     and his or her employer if the person was acting in

13     Sec. 25. Reimbursement for specialized rescue services. A
14 fire protection district may fix, charge, and collect
15 reasonable fees for specialized rescue services provided by the
16 district. The total amount collected may not exceed the
17 reasonable cost of providing those specialized rescue services
18 and may include an hourly rate per vehicle, an hourly rate per
19 firefighter, and the cost of materials. The fees may be charged
20 to the following parties:
21         (a) the owner of the property on which the specialized
22     rescue services occurred;
23         (b) any person involved in an activity that caused or
