1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Public Utilities Act is amended by adding
5 Section 16-107.5 as follows:
 
6     (220 ILCS 5/16-107.5 new)
7     Sec. 16-107.5. Net energy metering.
8     (a) The Legislature finds and declares that a program to
9 provide net energy metering for eligible customers can
10 encourage private investment in renewable energy resources,
11 stimulate economic growth, enhance the continued
12 diversification of Illinois' energy resource mix, and protect
13 the Illinois environment.
14     (b) As used in this Section: (i) an "eligible customer"
15 means a retail customer that owns and operates a solar or wind
16 electrical generating facility with a stated name plate
17 capacity of not more than 40 kilowatts that is located on the
18 customer's premises and is intended to offset part or all of
19 the customer's own electrical requirements and (ii) "net energy
20 metering" means the use of a secondary energy meter to measure
21 the amount of electricity provided to the electric utility by
22 the customer.
23     (c) An eligible customer shall pay for all costs associated

1 with the electric utility providing the required
2 interconnection and secondary meter needed, and if necessary
3 the real time pricing equipment needed, to participate in net
4 energy metering.
5     (d) Eligible customers participating in net energy
6 metering with electric utilities serving 200,000 or more
7 customers shall be reimbursed for the electricity supplied to
8 the utility based upon real-time pricing.
9     (e) Eligible customers participating in net energy
10 metering with electric utilities serving less than 200,000
11 customers shall be reimbursed for the electricity supplied to
12 the utility based upon the utility's avoided cost.
13     (f) The electric utility shall make all payments to
14 eligible customers promptly.
15     (g) Within 3 months after the effective date of this
16 amendatory Act of the 95th General Assembly, the Illinois
17 Commerce Commission shall establish standards for net energy
18 metering and the interconnection of solar and wind electric
19 generating equipment to the utility system if the Commission
20 determines that such standards are necessary for safe and
21 adequate service and further the public policy set forth in
22 this Section. The standards may include, but shall not be
23 limited to, standards designating:
24         (1) equipment necessary to automatically isolate the
25     residential solar and wind generating system from the
26     utility system for voltage and frequency deviations; and

1         (2) a manual lockable disconnect switch provided by the
2     customer which shall be located on the outside of the
3     residence and externally accessible for the purpose of
4     isolating the solar and wind electric generating
5     equipment.
6     (h) An electric utility shall offer net metering to
7 eligible customers until the load of its net energy metering
8 customers equals 0.1% of the total peak demand supplied by the
9 electric utility during the previous year. Electric utilities
10 are authorized to offer net energy metering beyond 0.1% of peak
11 load if they so choose.
 
12     Section 99. Effective date. This Act takes effect upon
13 becoming law.
