815 ILCS 505/2ZZ new

    Amends the Consumer Fraud and Deceptive Business Practices Act. Prohibits an insurance company or a health care provider from using a patient's social security number as the patient's identification number or in any mailings sent to the patient, except as required by federal regulations.

1     AN ACT concerning business.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Consumer Fraud and Deceptive Business
5 Practices Act is amended by adding Section 2ZZ as follows:
 
6     (815 ILCS 505/2ZZ new)
7     Sec. 2ZZ. Insurance companies; health care providers;
8 social security numbers.
9     (a) Except as may be required by federal regulations, an
10 insurance company shall not use a patient's social security
11 number as the patient's identification number or in any
12 mailings sent to the patient.
13     (b) Except as may be required by federal regulation, a
14 health care provider shall not use a patient's social security
15 number as the patient's identification number or in any
16 mailings sent to the patient.
17     (c) A violation of this Section constitutes an unlawful
18 practice within the meaning of this Act.
19     (d) For purposes of this Section:
20     "Insurance company" means a "company" as defined in Section
21 2 of the Illinois Insurance Code.
22     "Health care provider" means any physician, hospital
23 facility, or other person that is licensed or otherwise
