    Amends the Disaster Service Volunteer Leave Act. Permits a State employee to take no more than 20 days of unpaid leave per 12-month period to participate in disaster relief, upon approval of the employee's State agency. Effective immediately.

1     AN ACT concerning government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Disaster Service Volunteer Leave Act is
5 amended by changing Section 3 and by adding Section 3.5 as
6 follows:
 
7     (5 ILCS 335/3)  (from Ch. 127, par. 4053)
8     Sec. 3. Disaster Service Volunteer Paid Leave. An employee
9 of a State agency who is a certified disaster service volunteer
10 of the American Red Cross or assigned to the Illinois Emergency
11 Management Agency in accordance with the Illinois Emergency
12 Management Agency Act, the Emergency Management Assistance
13 Compact Act, or other applicable administrative rules may be
14 granted leave from his work with pay for not more than 20
15 working days in any 12-month period to participate in
16 specialized disaster relief services for the American Red Cross
17 or for the Illinois Emergency Management Agency, as the case
18 may be, upon the request of the American Red Cross or the
19 Illinois Emergency Management Agency for the services of that
20 employee and upon the approval of that employee's agency,
21 without loss of seniority, pay, vacation time, compensatory
22 time, personal days, sick time or earned overtime accumulation.
23 The agency shall compensate an employee granted leave under

1 this Section at his regular rate of pay for those regular work
2 hours during which the employee is absent from his work. For
3 purposes of assessing State disaster response needs, requests
4 made pursuant to this Act for services out-of-state shall be
5 coordinated by the American Red Cross and the Illinois
6 Emergency Management Agency through the Illinois State
7 Emergency Operations Center. The Illinois Emergency Management
8 Agency may consult with the Department of Central Management
9 Services on leave issues that could impact the operations of
10 State agencies under the Governor's jurisdiction. Leave under
11 this Act shall not be unreasonably denied for services related
12 to a disaster within the United States or its territories.

15     Sec. 3.5. Disaster Service Volunteer Unpaid Leave. An
16 employee of a State agency may be granted leave from his or her
17 work without pay for not more than 20 working days in any
18 12-month period to volunteer to assist in efforts to provide
19 relief to those persons and areas affected by a disaster upon
20 the approval of that employee's agency. The employee may take
21 additional unpaid leave for this purpose at the discretion of
22 his or her agency. Before the leave the employee shall furnish
23 proof satisfactory to his or her agency to substantiate the
24 volunteer work to be done through a legitimate aide
25 organization or governmental entity. An employee on such leave

1 shall not accrue sick days, vacation days, or other benefits
2 unless otherwise provided by a collective bargaining
3 agreement. The employee, however, shall not lose any such
4 benefits already accrued prior to the start of the unpaid
5 leave. Insurance benefits may be maintained during the unpaid
6 leave by the employee paying both the employee's and employer's
7 shares of such insurance benefits.
 
8     Section 99. Effective date. This Act takes effect upon
9 becoming law.
