Amends the Department of Human Services (Alcoholism and Substance Abuse)
Law of the Civil Administrative Code of Illinois. Provides that any person who is required to submit to a drug test within the State must pay a $2 fee. Provides that the funds shall be deposited into a special fund in the State treasury and may be used to make grants to drug courts for certain specified purposes. Creates the position of Statewide Drug Court Coordinator within the Department of Human Services. Amends the State Finance Act to make conforming changes.

| Sec. 310-5. Powers under certain Acts.

| (a) The Department of Human
Services, as successor to the

| Department of Alcoholism and Substance Abuse, shall exercise, |
11 |
| administer,
and enforce all rights, powers, and duties formerly |
12 |
| vested in the
Department of Mental Health and Developmental |
13 |
| Disabilities by the following
named Acts or Sections of those |
14 |
| Acts as they pertain to
the provision of alcoholism services |
15 |
| and the Dangerous Drugs
Commission:

| (1) The Cannabis Control Act.
|
17 |
| (2) The Illinois Controlled Substances Act.
|
18 |
| (3) The Community Mental Health Act.
|
19 |
| (4) The Community Services Act.
|
20 |
| (5) The Methamphetamine Control and Community |
21 |
| Protection Act.
|

| (b) Any person who is required to submit to a drug test in |

| the State for any reason must pay a $2 fee to the person or |
