SYNOPSIS AS INTRODUCED:

    Amends the Illinois Lottery Law. Requires the Department of Revenue to offer a special instant scratch-off game, named the wild about animals scratch-off game, for the benefit of endangered species, humane education programs, dogs, and cats to commence on January 1, 2008. Provides that the net revenue from the game shall be deposited into the Endangered Species Rehabilitation Fund for appropriation by the General Assembly as follows: (i) one-third of net revenue to the Department of Natural Resources for making grants for the maintenance of wildlife rehabilitation facilities that take care of threatened or endangered species; (ii) one-third of net revenue to the State Board of Education for character and humane education programs; and (iii) one-third of net revenue into the Pet Population Control Fund. Sets forth certain provisions for the operation of the scratch-off game. Amends the State Finance Act to create the Endangered Species Rehabilitation Fund. Effective immediately.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Lottery Law is amended by changing
5 Sections 2 and 20 and by adding Section 21.7 as follows:

7     Sec. 2. This Act is enacted to implement and establish
8 within the State a lottery to be operated by the State, the
9 entire net proceeds of which are to be used for the support of
10 the State's Common School Fund, except as provided in Sections
11 21.2, and 21.5, and 21.6, and 21.7.

15     Sec. 20. State Lottery Fund.
16     (a) There is created in the State Treasury a special fund
17 to be known as the "State Lottery Fund". Such fund shall
18 consist of all revenues received from (1) the sale of lottery
19 tickets or shares, (net of commissions, fees representing those
20 expenses that are directly proportionate to the sale of tickets
21 or shares at the agent location, and prizes of less than $600
22 which have been validly paid at the agent level), (2)

1 application fees, and (3) all other sources including moneys
2 credited or transferred thereto from any other fund or source
3 pursuant to law. Interest earnings of the State Lottery Fund
4 shall be credited to the Common School Fund.
5     (b) The receipt and distribution of moneys under Section
6 21.5 of this Act shall be in accordance with Section 21.5.
7     (c) (b) The receipt and distribution of moneys under
8 Section 21.6 of this Act shall be in accordance with Section
9 21.6.
10     (d) The receipt and distribution of moneys under Section
11 21.7 of this Act shall be in accordance with Section 21.7.

15     Sec. 21.7. Wild about animals scratch-off game.
16     (a) The Department shall offer a special instant
17 scratch-off game for the benefit of threatened or endangered
18 species, humane education programs, and dogs and cats. The game
19 shall commence on January 1, 2008 or as soon thereafter, in the
20 discretion of the Director, as is reasonably practical. The
21 operation of the game shall be governed by this Act and any
22 rules adopted by the Department. If any provision of this
23 Section is inconsistent with any other provision of this Act,
24 then this Section governs.
25     (b) The Endangered Species Rehabilitation Fund is created

1 as a special fund in the State treasury. The net revenue from
2 the wild about animals scratch-off game created under this
3 Section shall be deposited into the Fund for appropriation by
4 the General Assembly as follows:
5         (1) One-third of net revenue to the Department of
6     Natural Resources for making grants for the maintenance of
7     wildlife rehabilitation facilities that take care of
8     threatened or endangered species.
9         (2) One-third of net revenue to the State Board of
10     Education for character and humane education programs; and
11         (3) One-third of net revenue into the Pet Population
12     Control Fund.
13     Moneys received for the purposes of this Section,
14 including, without limitation, net revenue from the special
15 instant scratch-off game and from gifts, grants, and awards
16 from any public or private entity, must be deposited into the
17 Fund. Any interest earned on moneys in the Fund must be
18 deposited into the Fund. For purposes of this subsection, "net
19 revenue" means the total amount for which tickets have been
20 sold less the sum of the amount paid out in the prizes and the
21 actual administrative expenses of the Department solely
22 related to the scratch-off game under this Section.
23     (c) During the time that tickets are sold for the wild
24 about animals scratch-off game, the Department shall not
25 unreasonably diminish the efforts devoted to marketing any
26 other instant scratch-off lottery game.

1     (d) The Department may adopt any rules necessary to
2 implement and administer the provisions of this Section.
 
3     Section 10. The State Finance Act is amended by adding
4 Section 5.675 as follows:
 
5     (30 ILCS 105/5.675 new)
6     Sec. 5.675. The The Endangered Species Rehabilitation
7 Fund.
 
8     Section 99. Effective date. This Act takes effect upon
9 becoming law.
