SYNOPSIS AS INTRODUCED:
 
815 ILCS 505/2XX new

    Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that no person may sell consumer identification or purchasing information of Illinois residents to other persons without providing written notice to the Illinois resident before doing so and giving the resident 30 days after the resident receives the notice to refuse permission to sell his or her information. Provides that a notice must give the resident the option to refuse all sales or transfers of his or her information by that person. Makes it an unlawful practice to violate these provisions.

1     AN ACT concerning business.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Consumer Fraud and Deceptive Business
5 Practices Act is amended by adding Section 2XX as follows:
 
6     (815 ILCS 505/2XX new)
7     Sec. 2XX. Sale of consumer information. No person may sell
8 or transfer consumer identification or purchasing information
9 of Illinois residents to other persons without providing
10 written notice to the Illinois resident before doing so and
11 giving the resident 30 days after the resident receives the
12 notice to refuse permission to sell or transfer his or her
13 information. A notice under this Section must give the resident
14 the option to refuse all sales or transfers of his or her
15 information by that person. A person who violates this Section
16 commits an unlawful practice within the meaning of this Act.
