SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Methamphetamine Manufacturer Registry Act. Provides that the Department of State Police shall establish and maintain a Methamphetamine Manufacturer Database for the purpose of identifying methamphetamine manufacturers and making that information available to law enforcement and the general public. Provides that the Department of State Police must make the information contained in the Statewide Methamphetamine Manufacturer Database accessible on the Internet by means of a hyperlink labeled "Methamphetamine Manufacturer Information" on the Department's World Wide Web home page. Provides that the Department of State Police must update that information as it deems necessary. Provides that the Department of State Police must promulgate rules in accordance with the Illinois Administrative Procedure Act to implement these provisions and those rules must include procedures to ensure that the information in the database is accurate, and that the information in the database reflects any changes based on the reversal of a conviction for an offense requiring inclusion in the Methamphetamine Manufacturer Database, or a court order requiring the sealing or expungement of records relating to the offense. Effective immediately.

1     AN ACT concerning methamphetamine.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the
5 Methamphetamine Manufacturer Registry Act.
 
6     Section 5. Definition. As used in this Act,
7 "methamphetamine manufacturer" means a person who has been
8 convicted of any violation of Section 15 of the Methamphetamine
9 Control and Community Protection Act.
 
10     Section 10. Methamphetamine Manufacturer Database.
11     (a) The Department of State Police shall establish and
12 maintain a Methamphetamine Manufacturer Database for the
13 purpose of identifying methamphetamine manufacturers and
14 making that information available to law enforcement and the
15 general public. For every person convicted of a violation of
16 Section 15 of the Methamphetamine Control and Community
17 Protection Act on or after the effective date of this Act, the
18 methamphetamine manufacturer database shall contain
19 information relating to each methamphetamine manufacturer. The
20 information shall include the methamphetamine manufacturer's
21 name, date of birth, offense or offenses requiring inclusion in
22 the Methamphetamine Manufacturer Database, the conviction date
23 and county of each such offense, and such other identifying
24 information as the Department of State Police deems necessary
25 to identify the methamphetamine manufacturer, but shall not
26 include the social security number of the methamphetamine
27 manufacturer.
28     (b) The Department of State Police must make the
29 information contained in the Statewide Methamphetamine
30 Manufacturer Database accessible on the Internet by means of a
31 hyperlink labeled "Methamphetamine Manufacturer Information"

1 on the Department's World Wide Web home page. The Department of
2 State Police must update that information as it deems
3 necessary.
4     (c) The Department of State Police must promulgate rules in
5 accordance with the Illinois Administrative Procedure Act to
6 implement this Section and those rules must include procedures
7 to ensure that the information in the database is accurate, and
8 that the information in the database reflects any changes based
9 on the reversal of a conviction for an offense requiring
10 inclusion in the Methamphetamine Manufacturer Database, or a
11 court order requiring the sealing or expungement of records
12 relating to the offense. A certified copy of such an order
13 shall be deemed prima facie true and correct and, shall be
14 sufficient to require the immediate amendment or removal of any
15 person's information from the Methamphetamine Manufacturer
16 Database by the Department of State Police.
 
17     Section 15. Conviction Information.
18     (a) Within 60 days after the effective date of this Act,
19 each circuit clerk shall forward monthly to the Department of
20 State Police a copy of the judgment for each and all persons
21 convicted of an offense within the definition of
22 methamphetamine manufacturer, as defined in Section 5 of this
23 Act, during the previous month.
24     (b) Within 120 days after the effective date of this Act,
25 the Director of Corrections shall forward to the Department of
26 State Police a list of all persons incarcerated or on mandatory
27 supervised release, who have been convicted of an offense
28 within the definition of methamphetamine manufacturer, as
29 defined in Section 5 of this Act.
 
30     Section 99. Effective date. This Act takes effect upon
31 becoming law.
