AMENDMENT TO SENATE BILL 2558

2     AMENDMENT NO. ______. Amend Senate Bill 2558, AS AMENDED,
3 by replacing everything after the enacting clause with the
4 following:
 
5     "Section 1. Short title. This Act may be cited as the
6 Identity Document Protection Act.
 
7     Section 5. Contactless integrated circuits.
8     (a) No identity document created, mandated, or issued by
9 the State, a unit of local government, including a home rule
10 unit, or a school district may contain a contactless integrated
11 circuit that can broadcast personal information or enable
12 personal information to be scanned remotely.
13     (b) For the purposes of this Act, "contactless integrated
14 circuit" means a data carrying unit, such as an integrated
15 circuit or computer chip, that can be read remotely.
16     (c) This Section does not apply to the following, but only
17 when used for their commonly understood and expressly
18 identified purpose, except as provided in subsection (d):
19         (1) the I-Pass system of the Illinois State Toll
20     Highway Authority;
21         (2) badges issued to State or unit of local government
22     law enforcement, fire protection, and other public safety
23     personnel;
24         (3) identification documents issued to incarcerated

1     persons or persons who are under the terms of probation,
2     mandatory supervised release, or parole by the State or a
3     unit of local government;
4         (4) global positioning system receivers used in
5     surveying equipment or vehicles owned by the State or a
6     unit of local government;
7         (5) proximity cards or like devices used for security
8     access issued by the State or a unit of local government;
9         (6) passes, cards, or similar devices issued or sold to
10     passengers by a transportation authority, local mass
11     transit district, or unit of local government for the
12     payment of public transportation fares; and
13         (7) library cards issued to patrons by public libraries
14     for access to library services.
15     (d) The limitation on use to their commonly understood and
16 expressly identified purpose as provided in subsection (c) does
17 not apply when the use is by law enforcement personnel pursuant
18 to the provisions of Article 108A or Article 108B of the Code
19 of Criminal Procedure.
 
20     Section 10. Home rule. A home rule unit may not regulate
21 identity documents in a manner that is inconsistent with the
22 regulation by the State of identity documents under this Act.
23 This Section is a limitation under subsection (i) of Section 6
24 of Article VII of the Illinois Constitution on the concurrent
25 exercise by home rule units of powers and functions exercised
26 by the State.".
