625 ILCS 5/11-1404   from Ch. 95 1/2, par. 11-1404

    Amends the Illinois Vehicle Code. Provides that, during periods of traffic congestion, a person may, in a safe and prudent manner, operate a motorcycle between lanes of traffic or between adjacent lines or rows of vehicles. Requires every operator and passenger on a motorcycle, motor driven vehicle, or motorized pedalcycle to wear a helmet.

1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by changing
5 Section 11-1404 and adding Section 11-712 as follows:
 
6     (625 ILCS 5/11-712 new)
7     Sec. 11-712. Motorcycles; lane usage. A person may, in a
8 safe and prudent manner during periods of traffic congestion,
9 operate a motorcycle between lanes of traffic or between
10 adjacent lines or rows of vehicles.

12     Sec. 11-1404. Special equipment for persons riding
13 motorcycles, motor driven cycles or motorized pedalcycles.
14     (a) The operator and every passenger of a motorcycle, motor
15 driven cycle, or motorized pedalcycle must wear a helmet and
16 must and every passenger thereon shall be protected by glasses,
17 goggles or a transparent shield.
18     (b) For the purposes of this Section, glasses, goggles, and
19 transparent shields are defined as follows:
20     "Glasses" means ordinary eye pieces such as spectacles or
21 sunglasses worn before the eye, made of shatter-resistant
22 material. Shatter-resistant material, as used in this Section,
23 means material so manufactured, fabricated, or created that it
24 substantially prevents shattering or flying when struck or
25 broken.
26     "Goggles" means a device worn before the eyes, the
27 predominant function of which is protecting the eyes without
28 obstructing peripheral vision. Goggles shall provide
29 protection from the front and sides, and may or may not form a
30 complete seal with the face.
31     "Transparent shield" means a windshield attached to the

1 front of a motorcycle that extends above the eyes when an
2 operator is seated in the normal, upright riding position, made
3 of shatter-resistant material, or a shatter-resistant
4 protective face shield that covers the wearer's eyes and face
5 at least to a point approximately to the tip of the nose.
6     (c) Contact lenses are not acceptable eye protection
7 devices.
