SYNOPSIS AS INTRODUCED:

430 ILCS 120/25 new

    Amends the Illinois Manufactured Home Installers Act. Provides that a manufactured home installed on private property that is not a mobile home park must be installed so that it rests wholly on a permanent foundation. Provides that the permanent foundation must meet or exceed the requirements for a permanent foundation as defined in this amendatory Act or by federal rule. Effective immediately.

1     AN ACT concerning public safety.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Manufactured Home Installers Act is
5 amended by adding Sections 7 and 25 as follows:

7     Sec. 7. Definitions. As used in this Act:
8     "Manufactured home" is synonymous with "mobile home" and
9 means a structure that is a factory-assembled, completely
10 integrated structure designed for permanent habitation, with a
11 permanent chassis and so constructed as to permit its
12 transport, on wheels temporarily or permanently attached to its
13 frame, from the place of its construction to the location, or
14 subsequent locations, at which it is placed on a support system
15 for use as a permanent habitation, and designed and situated so
16 as to permit its occupancy as a dwelling place for one or more
17 persons. The term "manufactured home" includes manufactured
18 homes constructed after June 30, 1976 in accordance with the
19 federal National Manufactured Housing Construction and Safety
20 Standards Act of 1974 and does not include an immobilized
21 mobile home as defined in Section 2.10 of the Mobile Home Park
22 Act.
23     "Mobile home park" means a tract of land or 2 or more
24 contiguous tracts of land that contain sites with the necessary
25 utilities for 5 or more manufactured homes either free of
26 charge or for revenue purposes.
27     "Permanent foundation", for a manufactured home, means a
28 continuous perimeter foundation of material such as mortared
29 concrete block, mortared brick, or concrete that extends into
30 the ground below the established frost depth and to which the
31 home is secured with foundation bolts at least one-half inch in
32 diameter, spaced at intervals of no more than 6 feet and within

1 one foot of the corners, and embedded at least 7 inches into
2 concrete foundations or 15 inches into block foundations.

4     Sec. 25. Installation requirements. A manufactured home
5 installed on private property that is not in a mobile home park
6 on or after the effective date of this amendatory Act of the
7 94th General Assembly must be installed so that it rests wholly
8 on a permanent foundation. The permanent foundation must meet
9 or exceed the requirements for a permanent foundation as
10 defined in this amendatory Act of the 94th General Assembly or
11 as defined by rule of the federal Department of Housing and
12 Urban Development.
 
13     Section 99. Effective date. This Act takes effect upon
14 becoming law.
