SYNOPSIS AS INTRODUCED:
 
605 ILCS 5/3-105   from Ch. 121, par. 3-105

    Amends the Illinois Highway Code. Provides that, subject to specified exceptions, all money received by the State from the federal government for reimbursement for expenses incurred by the State for construction, reconstruction, or improvement of highways under the jurisdiction of the Department of Transportation (rather than for aid in construction of highways) shall be placed in the State Construction Account Fund (rather than the Road Fund). Effective July 1, 2005.

1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Highway Code is amended by changing
5 Section 3-105 as follows:
 
6     (605 ILCS 5/3-105)  (from Ch. 121, par. 3-105)
7     Sec. 3-105. Except as otherwise provided in the Treasurer
8 as Custodian of Funds Act, all money received by the State of
9 Illinois from the federal government for reimbursement for
10 expenses incurred by the State for aid in construction,
11 reconstruction, or improvement of highways under the
12 jurisdiction of the Department shall be placed in the State
13 Construction Account Fund "Road Fund" in the State Treasury.
14     Whenever any county having a population of 500,000 or more
15 inhabitants has incurred indebtedness and issued Expressway
16 bonds as authorized by Division 5-34 of the Counties Code and
17 has used the proceeds of such bonds for the construction of
18 Expressways in accordance with the provisions of Section 15d of
19 "An Act to revise the law in relation to roads and bridges",
20 approved June 27, 1913, as amended (repealed) or of Section
21 5-403 of this Code in order to accelerate the improvement of
22 the National System of Interstate Highways, the federal aid
23 primary highway network or the federal aid highway network in
24 urban areas, the State shall appropriate and allot, from the
25 allotments of federal funds made available by Acts of Congress
26 under the Federal Aid Road Act and as appropriated and made
27 available to the State of Illinois, to such county or counties
28 a sum sufficient to retire the bonded indebtedness due annually
29 arising from the issuance of those Expressway bonds issued for
30 the purpose of constructing Expressways in the county or
31 counties. Such funds shall be deposited in the Treasury of such
32 county or counties for the purpose of applying such funds to

1 the payment of the Expressway bonds, principal and interest due
2 annually, issued pursuant to Division 5-34 of the Counties
3 Code.
