SYNOPSIS AS INTRODUCED:
 
20 ILCS 2310/2310-412 new

    Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Requires the Department of Public Health to develop a plan for establishing a program to: (1) provide for the private storage of cord blood for individuals who are unable to afford to store cord blood through a private cord blood bank; and (2) provide for the donation of stem cells at the time of an individual's death. Requires the Department to complete its development of the plan by January 1, 2006. Provides that upon developing the plan and subject to appropriation, the Department shall implement a pilot program for the private storage of cord blood and the donation of stem cells at the time of an individual's death in accordance with the plan. Provides that the Department may implement the pilot program in one or more regions of the State. Effective immediately.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Public Health Powers and
5 Duties Law of the Civil Administrative Code of Illinois is
6 amended by adding Section 2310-412 as follows:
 
7     (20 ILCS 2310/2310-412 new)
8     Sec. 2310-412. Cord blood storage; adult stem cell
9 donations.
10     (a) The Department shall develop a plan for establishing a
11 program to do both of the following:
12         (1) Provide for the private storage of cord blood for
13     individuals who are unable to afford to store cord blood
14     through a private cord blood bank.
15         (2) Provide for the donation of stem cells at the time
16     of an individual's death.
17     The Department shall complete its development of the plan
18 by January 1, 2006.
19     (b) Upon developing the plan under subsection (a) and
20 subject to appropriation, the Department shall implement a
21 pilot program for the private storage of cord blood and the
22 donation of stem cells at the time of an individual's death in
23 accordance with the plan. The Department may implement the
24 pilot program in one or more regions of the State.
25     (c) The Department shall adopt rules as necessary to
26 implement the pilot program.
 
27     Section 99. Effective date. This Act takes effect upon
28 becoming law.
