1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of State Police Law of the Civil
5 Administrative Code of Illinois is amended by changing Section
6 2605-327 as follows:
 
7     (20 ILCS 2605/2605-327)
8     Sec. 2605-327. Conviction and sex offender information for
9 medical school. Upon the inquiry request of a medical school
10 under the Medical School Matriculant Criminal History Records
11 Check Act, to ascertain whether a matriculant of the medical
12 school has been convicted of any violent felony or has been
13 adjudicated a sex offender.
14     The Department shall make sex offender information
15 available to the inquiring medical school through the Statewide
16 Sex Offender Database. Medical schools in this State must
17 conduct an inquiry into the Statewide Sex Offender Database on
18 all matriculants as part of the admissions process. furnish
19 this information to the medical school that requested the
20 information.
21     Pursuant to the Medical School Matriculant Criminal
22 History Records Check Act, the Department shall conduct a
23 fingerprint-based criminal history records check of the
24 Statewide Sex Offender Database, the Illinois criminal history
25 records database, and the Federal Bureau of Investigation
26 criminal history records database upon the request of a public
27 medical school. Pursuant to the Medical School Matriculant
28 Criminal History Records Check Act, the Department shall
29 conduct a fingerprint-based, Illinois Uniform Conviction
30 Information Act check of the Illinois criminal history records
31 database upon the request of a private medical school. The
32 Department may charge the requesting public or private medical

1 school a fee for conducting the fingerprint-based criminal
2 history records check. The fee shall not exceed the cost of the
3 inquiry and shall be deposited into the State Police Services
4 Fund.

6     Section 10. The Medical School Matriculant Criminal
7 History Records Check Act is amended by changing Sections 10
8 and 25 as follows:

10     Sec. 10. Criminal history records check for matriculants.
11     (a) A public medical school located in Illinois must
12 conduct an inquiry into the Department of State Police's
13 Statewide Sex Offender Database for each matriculant and must
14 require that each matriculant submit to a fingerprint-based
15 criminal history records check for violent felony convictions,
16 and any adjudication of the matriculant as a sex offender
17 conducted by the Department of State Police and the Federal
18 Bureau of Investigation, as part of the medical school
19 admissions process. The A medical school shall forward the
20 name, sex, race, date of birth, social security number, and
21 fingerprints of each of its matriculants to the Department of
22 State Police to be searched against the Statewide Sex Offender
23 Database and the fingerprint records now and hereafter filed in
24 the Department of State Police and Federal Bureau of
25 Investigation criminal history records databases. The
26 fingerprints of each matriculant must be submitted in the form
27 and manner prescribed by the Department of State Police. The
28 Department of State Police shall furnish, pursuant to positive
29 identification, records of a matriculant's violent felony
30 convictions and any record of a matriculant's adjudication as a
31 sex offender to the medical school that requested the criminal
32 history records check.
33     (b) A private medical school located in Illinois must
34 conduct an inquiry into the Department of State Police's

1 Statewide Sex Offender Database for each matriculant and must
2 require that each matriculant submit to an Illinois Uniform
3 Conviction Information Act fingerprint-based, criminal history
4 records check for violent felony convictions, conducted by the
5 Department of State Police, as part of the medical school
6 admissions process. The medical school shall forward the name,
7 sex, race, date of birth, social security number, and
8 fingerprints of each of its matriculants to the Department of
9 State Police to be searched against the fingerprint records now
10 and hereafter filed in the Department of State Police criminal
11 history records database. The fingerprints of each matriculant
12 must be submitted in the form and manner prescribed by the
13 Department of State Police. The Department of State Police
14 shall furnish, pursuant to positive identification, records of
15 a matriculant's violent felony convictions to the medical
16 school that requested the criminal history records check.

19     Sec. 25. Civil immunity. Except for wilful or wanton
20 misconduct, no medical school acting under the provisions of
21 this Act shall be civilly liable to any matriculant for
22 reporting any required information to the Department of State
23 Police or for any decision made pursuant to Section 20 of this
24 Act.

26     Section 99. Effective date. This Act takes effect upon
27 becoming law.
