AMENDMENT TO SENATE BILL 342

2     AMENDMENT NO. ______. Amend Senate Bill 342 by replacing
3 the title with the following:
4     "AN ACT concerning firearms."; and
 
5 by replacing everything after the enacting clause with the
6 following:
 
7     "Section 5. The Firearm Owners Identification Card Act is
8 amended by changing Section 2 as follows:
 
9     (430 ILCS 65/2)  (from Ch. 38, par. 83-2)
10     Sec. 2. Firearm Owner's Identification Card required;
11 exceptions.
12     (a) (1) No person may acquire or possess any firearm within
13     this State without having in his or her possession a
14     Firearm Owner's Identification Card previously issued in
15     his or her name by the Department of State Police under the
16     provisions of this Act.
17         (2) No person may acquire or possess firearm ammunition
18     within this State without having in his or her possession a
19     Firearm Owner's Identification Card previously issued in
20     his or her name by the Department of State Police under the
21     provisions of this Act.
22     (b) The provisions of this Section regarding the possession
23 of firearms and firearm ammunition do not apply to:

1         (1) United States Marshals, while engaged in the
2     operation of their official duties;
3         (2) Members of the Armed Forces of the United States or
4     the National Guard, while engaged in the operation of their
5     official duties;
6         (3) Federal officials required to carry firearms,
7     while engaged in the operation of their official duties;
8         (4) Members of bona fide veterans organizations which
9     receive firearms directly from the armed forces of the
10     United States, while using the firearms for ceremonial
11     purposes with blank ammunition;
12         (5) Nonresident hunters during hunting season, with
13     valid nonresident hunting licenses and while in an area
14     where hunting is permitted; however, at all other times and
15     in all other places these persons must have their firearms
16     unloaded and enclosed in a case;
17         (6) Those hunters exempt from obtaining a hunting
18     license who are required to submit their Firearm Owner's
19     Identification Card when hunting on Department of Natural
20     Resources owned or managed sites;
21         (7) Nonresidents while on a firing or shooting range
22     recognized by the Department of State Police; however,
23     these persons must at all other times and in all other
24     places have their firearms unloaded and enclosed in a case;
25         (8) Nonresidents while at a firearm showing or display
26     recognized by the Department of State Police; however, at
27     all other times and in all other places these persons must
28     have their firearms unloaded and enclosed in a case;
29         (9) Nonresidents whose firearms are unloaded and
30     enclosed in a case;
31         (10) Nonresidents who are currently licensed or
32     registered to possess a firearm in their resident state;
33         (11) Unemancipated minors while in the custody and
34     immediate control of their parent or legal guardian or

1     other person in loco parentis to the minor if the parent or
2     legal guardian or other person in loco parentis to the
3     minor has a currently valid Firearm Owner's Identification
4     Card;
5         (12) Color guards of bona fide veterans organizations
6     or members of bona fide American Legion bands while using
7     firearms for ceremonial purposes with blank ammunition;
8         (13) Nonresident hunters whose state of residence does
9     not require them to be licensed or registered to possess a
10     firearm and only during hunting season, with valid hunting
11     licenses, while accompanied by, and using a firearm owned
12     by, a person who possesses a valid Firearm Owner's
13     Identification Card and while in an area within a
14     commercial club licensed under the Wildlife Code where
15     hunting is permitted and controlled, but in no instance
16     upon sites owned or managed by the Department of Natural
17     Resources;
18         (14) Resident hunters who are properly authorized to
19     hunt and, while accompanied by a person who possesses a
20     valid Firearm Owner's Identification Card, hunt in an area
21     within a commercial club licensed under the Wildlife Code
22     where hunting is permitted and controlled; and
23         (15) A person who is otherwise eligible to obtain a
24     Firearm Owner's Identification Card under this Act and is
25     under the direct supervision of a holder of a Firearm
26     Owner's Identification Card who is 21 years of age or older
27     while the person is on a firing or shooting range or is a
28     participant in a firearms safety and training course
29     recognized by a law enforcement agency or a national,
30     statewide shooting sports organization; and .
31         (16) Illinois residents, including active duty
32     military personnel currently stationed in Illinois, who
33     are in possession of a current, valid identification card
34     issued by the United States Uniformed Services. The

1     identification card shall be accepted in lieu of a Firearm
2     Owner's Identification Card in all instances under the laws
3     of Illinois where a Firearm Owner's Identification Card is
4     required. The branch of service shall be recorded in place
5     of the Firearm Owner's Identification Card number in any
6     matter that requires the recording of the Firearm Owner's
7     Identification Card number.
8     (c) The provisions of this Section regarding the
9 acquisition and possession of firearms and firearm ammunition
10 do not apply to law enforcement officials of this or any other
11 jurisdiction, while engaged in the operation of their official
12 duties.

14     Section 99. Effective date. This Act takes effect upon
15 becoming law.".
