AMENDMENT TO SENATE BILL 251

2     AMENDMENT NO. ______. Amend Senate Bill 251, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The Recreational Use of Land and Water Areas
6 Act is amended by changing Sections 1 and 2 as follows:
 
7     (745 ILCS 65/1)  (from Ch. 70, par. 31)
8     Sec. 1. This Act shall be known and may be cited as the
9 "Recreational Use of Land and Water Areas Act".
10     The purpose of this Act is to encourage owners of land to
11 make land and water areas available to any individual or, on
12 State-owned or managed lands and waters, members of the public
13 for recreational or conservation purposes by limiting their
14 liability toward persons entering thereon for such purposes.

17     Sec. 2. As used in this Act, unless the context otherwise
18 requires:
19     (a) "Land" includes roads, water, watercourses, private
20 ways and buildings, structures, and machinery or equipment when
21 attached to the realty, but does not include residential
22 buildings.
23     (b) "Owner" includes the possessor of any interest in land,

1 whether it be a tenant, lessee, occupant, the State of Illinois
2 and its political subdivisions, or person in control of the
3 premises.
4     (c) "Recreational or conservation purpose" means entry
5 onto the land of another to conduct any of the following
6 activities or a combination thereof, hunting, hiking,
7 recreational shooting, rock climbing, trapping, horseback
8 riding of the entrant's own horse or horses, fishing, swimming,
9 boating, camping, picnicking, and operation of an off-highway
10 vehicle to pursue any of the listed activities. any activity
11 undertaken for conservation, resource management, exercise,
12 education, relaxation, or pleasure on land owned by another.
13     (d) "Charge" means an admission fee for permission to go
14 upon the land, but does not include: the sharing of game, fish
15 or other products of recreational use; or benefits to or
16 arising from the recreational use; or contributions in kind,
17 services or cash made for the purpose of properly conserving
18 the land.
19     (e) "Person" includes any person, regardless of age,
20 maturity, or experience, who enters upon or uses land for
21 recreational purposes.

23     Section 99. Effective date. This Act takes effect upon
24 becoming law.".
