SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/12-610.1 new

    Amends the Illinois Vehicle Code. Provides that a person who holds an instruction permit or a graduated license may not use a wireless phone while driving a vehicle. Provides that the prohibition does not apply to use of a wireless phone to contact a law enforcement agency, health care provider, or emergency services agency for emergency purposes. Effective immediately.

1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by adding
5 Section 12-610.1 as follows:
 
6     (625 ILCS 5/12-610.1 new)
7     Sec. 12-610.1. Wireless telephones.
8     (a) As used in this Section, "wireless telephone" means a
9 device that is capable of transmitting or receiving telephonic
10 communications without a wire connecting the device to the
11 telephone network.
12     (b) A person who holds an instruction permit issued under
13 Section 6-105 or 6-107.1, or a person who holds a graduated
14 license issued under Section 6-107, may not drive a vehicle
15 while using a wireless phone.
16     (c) This Section does not apply to a person using a
17 wireless telephone for emergency purposes, including, but not
18 limited to, an emergency call to a law enforcement agency,
19 health care provider, fire department, or other emergency
20 services agency or entity.
 
21     Section 99. Effective date. This Act takes effect upon
22 becoming law.
