SYNOPSIS AS INTRODUCED:
 
730 ILCS 5/3-12-5   from Ch. 38, par. 1003-12-5

    Amends the Unified Code of Corrections. Provides that a prisoner performing a work assignment in a correctional employment program shall receive a daily wage of $25 or a higher amount determined by administrative rule of the Department of Corrections.

1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Unified Code of Corrections is amended by
5 changing Section 3-12-5 as follows:
 
6     (730 ILCS 5/3-12-5)  (from Ch. 38, par. 1003-12-5)
7     Sec. 3-12-5. Compensation. A person Persons performing a
8 work assignment under subsection (a) of Section 3-12-2 shall
9 may receive a wage of $25 per day or a higher amount
10 established wages under rules and regulations of the
11 Department. In determining rates of compensation if more than
12 $25 per day, the Department shall consider the effort, skill
13 and economic value of the work performed. Compensation may be
14 given to persons who participate in other programs of the
15 Department. Of the compensation earned pursuant to this
16 Section, a portion, as determined by the Department, shall be
17 used to offset the cost of the committed person's
18 incarceration. If the committed person files a lawsuit
19 determined frivolous under Article XXII of the Code of Civil
20 Procedure, 50% of the compensation shall be used to offset the
21 filing fees and costs of the lawsuit as provided in that
22 Article until all fees and costs are paid in full. All other
23 wages shall be deposited in the individual's account under
24 rules and regulations of the Department. The Department shall
25 notify the Attorney General of any compensation applied towards
26 a satisfaction, in whole or in part, of the person's
27 incarceration costs.
