SYNOPSIS AS INTRODUCED:
 
ILCON Art. VIII, Sec. 2

    Proposes to amend the Finance Article of the Illinois Constitution. For an appropriation for a fiscal year when the aggregate appropriation of all moneys other than those belonging to special funds exceeds that of the previous fiscal year, requires a three-fifths affirmative vote of each house for passage of the appropriation if during the previous fiscal year borrowing occurred due to cash flow timing variations or revenue shortfalls. Effective upon being declared adopted.

CONSTITUTIONAL AMENDMENT

 
3     RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
4 NINETY-FOURTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE
5 SENATE CONCURRING HEREIN, that there shall be submitted to the
6 electors of the State for adoption or rejection at the general
7 election next occurring at least 6 months after the adoption of
8 this resolution a proposition to amend Article VIII of the
9 Illinois Constitution by changing Section 2 as follows:

13 SECTION 2. STATE FINANCE
14     (a) The Governor shall prepare and submit to the General
15 Assembly, at a time prescribed by law, a State budget for the
16 ensuing fiscal year. The budget shall set forth the estimated
17 balance of funds available for appropriation at the beginning
18 of the fiscal year, the estimated receipts, and a plan for
19 expenditures and obligations during the fiscal year of every
20 department, authority, public corporation and quasi-public
21 corporation of the State, every State college and university,
22 and every other public agency created by the State, but not of
23 units of local government or school districts. The budget shall
24 also set forth the indebtedness and contingent liabilities of
25 the State and such other information as may be required by law.
26 Proposed expenditures shall not exceed funds estimated to be
27 available for the fiscal year as shown in the budget.
28     (b) The General Assembly by law shall make appropriations
29 for all expenditures of public funds by the State.
30 Appropriations for a fiscal year shall not exceed funds
31 estimated by the General Assembly to be available during that
32 year.
33     (c) For an appropriation for a fiscal year in which the

1 total aggregate appropriation of all moneys not belonging to
2 any special fund in the State treasury exceeds that of the
3 prior fiscal year, an affirmative vote of three-fifths of the
4 members of each house of the General Assembly shall be required
5 to approve the appropriation if during the prior fiscal year:
6 (1) borrowing occurred due to significant timing variations
7 between disbursement and receipt of budgeted funds in
8 anticipation of revenues to be collected that year, or (2)
9 borrowing occurred due to failures in revenues of the State.

SCHEDULE
12     This Constitutional Amendment takes effect upon being
13 declared adopted in accordance with Section 7 of the Illinois
14 Constitutional Amendment Act.
