1     AN ACT concerning vehicles.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by changing
5 Sections 3-638, 3-806 and 3-806.4 as follows:
 
6     (625 ILCS 5/3-638)
7     Sec. 3-638. U.S. Veteran License Plates.
8     (a) In addition to any other special license plate, the
9 Secretary, upon receipt of all applicable fees and applications
10 made in the form prescribed by the Secretary of State, may
11 issue U.S. Veteran license plates to residents of Illinois who
12 meet eligibility requirements prescribed by the Secretary of
13 State. Upon the Secretary's receipt of the proper application,
14 the surviving spouse of a person who was issued special
15 registration plates under this Section may keep the special
16 registration plates and may transfer the registration, if
17 necessary. If the surviving spouse remarries, however, the
18 special plates may not be renewed. The special U.S. Veteran
19 plate issued under this Section shall be affixed only to
20 passenger vehicles of the first division, motorcycles, and
21 motor vehicles of the second division weighing not more than
22 8,000 pounds. Plates issued under this Section shall expire
23 according to the staggered multi-year procedure established by
24 Section 3-414.1 of this Code.
25     (b) The design, color, and format of the plates shall be
26 wholly within the discretion of the Secretary of State. The
27 Secretary may, in his or her discretion, allow the plates to be
28 issued as vanity plates or personalized in accordance with
29 Section 3-405.1 of this Code. The plates are not required to
30 designate "Land Of Lincoln", as prescribed in subsection (b) of
31 Section 3-412 of this Code. The Secretary shall prescribe the
32 eligibility requirements and, in his or her discretion, shall

1 approve and prescribe stickers or decals as provided under
2 Section 3-412.
3     (c) An applicant shall be charged a $15 fee for original
4 issuance in addition to the applicable registration fee. This
5 additional fee shall be deposited into the Secretary of State
6 Special License Plate Fund.

9     Sec. 3-806. Registration Fees; Motor Vehicles of the First
10 Division. Every owner of any other motor vehicle of the first
11 division, except as provided in Sections 3-804, 3-805, 3-806.3,
12 3-806.4, and 3-808, and every second division vehicle weighing
13 8,000 pounds or less, shall pay the Secretary of State an
14 annual registration fee at the following rates:

13     Sec. 3-806.4. Gold Star recipients. Commencing with the
14 1991 registration year and through the 2006 registration year,
15 upon proper application, the Secretary of State shall issue one
16 pair of registration plates to any Illinois resident, who as
17 the surviving widow or widower, or in the absence thereof, as
18 the surviving parent, is awarded the Gold Star by the United
19 States in recognition of spouses or children who served in the
20 Armed Forces of the United States and lost their lives while in
21 service whether in peacetime or war. Commencing with the 2007
22 registration year, upon proper application, the Secretary of
23 State shall issue one pair of registration plates to any
24 Illinois resident, who as the surviving widow, widower, or
25 parent, is awarded the Gold Star by the United States in
26 recognition of spouses or children who served in the Armed
27 Forces of the United States and lost their lives while in
28 service whether in peacetime or war. If the parent no longer
29 survives, the Secretary of State shall issue the plates to a
30 surviving sibling, of the person who served in the Armed
31 Forces, who is an Illinois resident. No more than one set of
32 plates shall be issued for each Gold Star awarded, and only one
33 surviving parent, or in the absence of a surviving parent, only
34 one surviving sibling shall be issued a set of registration
35 plates, except for those surviving parents who, as recipients

1 of the Gold Star, have legally separated or divorced, in which
2 case each surviving parent shall be allowed one set of
3 registration plates. Registration plates issued under this
4 Section shall be for first division vehicles and second
5 division vehicles of 8,000 pounds or less. Through the 2006
6 registration year, an applicant shall be charged a $15 fee for
7 the original issuance in addition to the appropriate
8 registration fee which shall be deposited into the Road Fund to
9 help defray the administrative processing costs. Beginning
10 with the 2007 registration year, an applicant shall not be
11 charged any only the appropriate registration fee or fee for
12 issuance of the plates.

15     Section 99. Effective date. This Act takes effect upon
16 becoming law.
